<br />. <br /> <br />. <br /> <br />. <br /> <br />- <br /> <br />~ <br />~HILLS <br /> <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 05-47 <br /> <br />RESOLUTION FINDING A NEGATIVE DECLARATION FOR THE PREPERATION <br />OF AN ENVIRONMENTAL ASSESSMENT WORKSHEET FOR THE PLANNED UNIT <br />DEVELOPMENT, PUD PERMIT, AND PRELIMINARY PLAT FOR ROYAL OAKS <br />REALTY <br /> <br />WHEREAS: Minnesota Rules Chapter 4410 establishes a process by which citizens <br />may file a petition to have a Responsible Government Unit (RGU) order an <br />Environmental Assessment Worksheet (EAW); and <br /> <br />WHEREAS: on July 18, 2005, the Minnesota State Environmental Quality Board <br />received an EAW citizen petition and determined that the City of Arden Hills was <br />the Responsible Government Unit (RGU); and <br /> <br />WHEREAS: Minnesota Rules Chapter 4410.4300, Subpart 14 - Mandatory EAW <br />Categories; Industrial, Commercial, and Institutional Facilities lists the threshold <br />for a mandatory EAW for a commercial development in a third or fourth class city <br />is 200,000 square feet; and <br /> <br />WHEREAS: Minnesota Rules Chapter 4410.4600, Subpart 10- Exemptions; Industrial, <br />Commercial, and Institutional Facilities - lists commercial development in a third <br />or fourth class city at or below 50,000 square feet as exempt from an EAW; and <br /> <br />WHEREAS: Minnesota Rules establish that when a development project is neither <br />mandatory or exempt, an EAW may be ordered by the RGU either on their own <br />initiative or by citizen petition when the facts indicate that the project "may have <br />the potential for significant environmental impacts"; and <br /> <br />WHEREAS: Minnesota Rules define "environmental" to mean physical conditions, <br />including: land, air, water, minerals, flora, fauna, ambient noise, energy <br />resources, and artifacts or natural features of historic, geologic or aesthetic <br />significance; and <br /> <br />WHEREAS: In preparation for the development of the subject parcel a series of studies <br />were conducted, including the following: <br /> <br />WHEREAS: The City of Arden Hills received a Wetland Delineation Report for the <br />fOrmer City Hall and Public Works site on November 2004; and <br />
