<br /> Status: The trail along the western edge of the property will be dedicated for public use <br /> under Outlot A on the Final Plat <br /> . 30. Easement Vacation. The twenty foot wide pedestrian easement near the center of the <br /> property shall be vacated prior to filing the Final Plat <br /> Status: The easement that runs north and south in the central portion of the property will <br /> be vacated after a public hearing is held by the City Council on October 10th, 2006. <br /> Landscaping Plan. There were a number of conditions in the PUD and preliminary plat <br /> approval related to the landscaping plan. The ehanges to the landscaping plan are <br /> required to be submitted for approval before any building permits are issued. However, <br /> the applicant has submitted a revised landscaping plan. The revised plan exceeds the <br /> minimum required number of trees and caliper inches (condition 9b). Furthermore, the <br /> revised plan provides more trees of a higher caliper size to bring the plan into <br /> conformance with the City's landscaping requirements (eondition 9b). The revised plan <br /> also includes coniferous trees near the southeast comer of unit 16 to provide additional <br /> screening for properties to the south (condition 9c). A few of the trees along the western <br /> edge of the property may need to be replaccd with eoniferous trees to provide additional <br /> screening for the trail (condition 9a). <br /> While comments regarding the landscaping plan can be made, the applicant does have <br /> additional time to revise the plans to fully comply with the conditions applied to the <br /> . landscaping plan. <br /> Staff Recommendation <br /> The Final PIal is in conformance with the requirements ofthe PUD & Preliminary Plat Approval <br /> and with the requirements of the City's Subdivision Ordinance. Therefore, in Planning Case <br /> #06-029, Staffrceommends approval of the Final Plat subject to the following six conditions: <br /> 1. The applicant shall continue to be subject to all of the conditions for the PUD as <br /> approved in Planning Case 06-023. <br /> 2. The developer shall file the Final Plat with the Ramsey County Recorder and provide the <br /> City with a recorded copy within sixty days of approval. <br /> ~ The applicant shall pay a park dedication fee of $40,000 as required in the purchase <br /> ~. <br /> agreement. <br /> 4. The developer shall cnter shall enter into a Development Agreement with the City, which <br /> must be executed prior to the release of the Final Plat and be subject to review by the City <br /> Attorney. <br /> s.
