8 <br />event using the approach results in a violation or alleged violation of <br />the ERISA trust requirement. <br />2. If Benefit Extras is collecting Continuation Coverage Premiums with <br />respect to a Continuation Participant, Benefit Extras shall prepare <br />and send a notice of an insufficient premium payment to the <br />Continuation Participant within one (1) business day of receipt of an <br />insufficient Continuation Coverage Premium payment, provided <br />Employer has not directed Benefit Extras to accept Insignificant <br />Shortfalls and the insufficient premium payment constitutes an <br />Insignificant Shortfall. <br />L. Open Enrollment. Benefit Extras shall distribute annual enrollment <br />materials to Qualified Beneficiaries and Continuation Participants entitled to <br />participate in open enrollment during the applicable annual open enrollment <br />period and answer questions from Qualified Beneficiaries and Continuation <br />Participants regarding open enrollment. At the conclusion of the open <br />enrollment period, Benefit Extras shall provide to Employer and the <br />applicable insurance carriers and/or third-party service providers enrollment <br />and/or election information regarding the Qualified Beneficiaries and <br />Continuation Participants. Employer (or its designee) shall provide to <br />Benefit Extras all information necessary to allow such Qualified Beneficiaries <br />and Continuation Participants to participate in open enrollment and Benefit <br />Extras is entitled to rely upon the information provided by Employer (or its <br />designee) and is under no obligation to independently verify such <br />information. Notwithstanding anything herein to the contrary, Benefit <br />Extras shall distribute annual enrollment materials to Continuation <br />Participants only for the Plan or Plans in which they are currently enrolled <br />and to Qualified Beneficiaries only for the Plan or Plans in which they were <br />enrolled at the time of the Qualifying Event. <br />M. Reports. At the end of each month, Benefit Extras will prepare reports <br />detailing the ongoing activities and status for each Qualified Beneficiary and <br />Continuation Participant. Such reports are provided to Employer via email. <br />N. Administrative Materials. Benefit Extras shall prepare documentation <br />relating to Continuation Coverage under the Plans, including, but not limited <br />to, initial notices of rights, election notices, election forms, and various <br />administrative forms. <br />O. Compliance with Applicable Law. Benefit Extras shall comply with applicable <br />federal and state laws and regulations applicable to Benefit Extras' <br />responsibilities under this Agreement.
