MEMORANDUM <br /> DATE: October 13, 1998 <br /> TO: Mayor and City Council <br /> . <br /> FROM: Kevin Ringwald, Assistant to the City Administrato <br /> SUBJECT: 1369 Forest Lane - Demolition <br /> Request <br /> The Staff requests authorization to proceed with the demolition of the home at 1369 Forest Lane. <br /> Backl:round <br /> The City Council at its Monday, September 28,1998, meeting stayed the demolition of the home <br /> at 1369 Forest Lane, subject to the applicant complying with the following conditions: <br /> 1. On or before Tuesday, October 13, 1998, provide evidence to the City Council that the <br /> property owner has obtained the necessary funds (including any fees) to bring the house <br /> into full code compliance; <br /> 2. On or before Tuesday, October 13, 1998, provide evidence to the City Council that the <br /> . property owner has obtained a building permit from the Building Official; and <br /> 3. Within thirty (30) days of the approval of said plans by the Building Official have <br /> completed all necessary work to bring the home into full code compliance and obtain a <br /> Certificate of Occupancy. <br /> As of Friday, October 9,1998, the property owner has not complied with any of three stated <br /> conditions. The property owner has informed Staff by telephone that he has obtained <br /> constmction financing for the necessary improvements, from a private source. The Staff <br /> reiterated its concerns to the property owner that the amount of financing required be great <br /> enough to cover the necessary improvements. The Fire Marshall at the time of the fire estimated <br /> that the minimum amount required would be $60,000, while the insurance company estimated <br /> that the minimum amount required would be in excess of $90,000. <br /> The Staff has requested that the property owner provide evidence of constmction financing of at <br /> least $60,000. In conjunction with this the Staff has also requested that the property owner <br /> provide the Staff with a sworn construction statement from the contractor(s) which would detail <br /> their costs and the timing of their payment which would enable Staff to determine the minimum <br /> financing amount required. <br /> The Building Official has requested that the City Attorney notifY the Court of the proceedings of <br /> the City Council. The City Attorney has informed Staff that they will be notifying the Court of <br /> the City Council's actions to date. <br /> . <br />
