Case #98-02, Variance - Side Yard Setback (garage & house addition), Sawhorse, Inc. <br /> (Joel & Jane Kennedy), 3465 Seims Court <br /> Request. The applicant is requesting approval of a side yard setback variance for a garage <br /> addition (seven feet proposed, when ten feet is required) and for a house addition (seven feet, <br /> when ten feet is required) on a single family lot zoned R-I (Exhibit A). <br /> Background. The Planning Commission on June 3, 1991, recommended approval in <br /> Planning Case #92-10 for a side yard setback variance for a garage addition (seven feet <br /> proposed, when ten feet is required) on the subject property (Exhibit B). The City Council <br />. on June 8, 1992, approved the variance request (Exhibit C). <br /> The garage addition that was proposed in Planning Case #92-10 provided the property owner <br /> with the ability to expand their one-car garage into a two-car garage. The garage addition <br /> was not built. Subsequent to the City's approval, the property has been sold to a ne'-Y owner <br /> (Joel and Jane Kennedy) who in conjunction with their contractor (Sawhorse, Inc.) wish to <br /> build the garage addition. However, the Zoning Ordinance in Section VIII, F, 2, states in <br /> relevant part that: "Approval shall automatically expire and become void one (I) year from <br /> and after the date on which the council granted such approval if the building permit or other <br /> approved improvements have not been issued a permit by the building inspector." Therefore, <br /> the approval granted in Planning Case #92-10 expired on June 8, 1993. <br /> As a note, the current request for a side yard setback variance (house addition) was not part <br /> of the approval granted in Planning Case #92-10. Therefore in this request, Staff will be <br /> analyzing the variance for the garage addition and the variance for the house addition <br /> separately. <br /> Deadline for Agency Actions. The City of Arden Hills received the complete application <br /> for this request on January 15,1998. Pursuant to Minnesota State Statute the City must act <br /> on this request by Monday, March 16, 1998 (60 days), unless the City provides the petitioner <br /> with written reasons for an additional 60 day review period. The additional review period <br />. would extend to Friday, May 15, 1998. The City may with the petitioners consent extend <br /> the review period beyond the Friday, May 15, 1998, date. <br />
