Case 98-03, City of Arden Hills, Zoning Ordinance - modification (regulating <br /> pawnshops) <br /> Request. The City of Arden Hills requests approval of an amendment to the Zoning <br /> Ordinance which would identify pawnshops as a prohibited use in all zoning districts <br /> (Exhibit J). <br /> Background. The Planning Commission and Staff have been working on the regulation of <br /> pawnshops, gunshops, and sexually oriented businesses for some time now. The discussion <br /> on pawnshops has progressed to a point that action is appropriate. These discussions are to <br /> be considered incorporated by reference into this report. The proposed amendment to the <br /> Zoning Ordinance would prohibit pawnshops from operating in the City. <br /> The City Attorney has concluded that this activity does not involve constitutionally protected <br /> activity and that the State Enabling Legislation provides Cities the flexibility on whether or <br /> not to license these activities. Therefore based on this advice, the Plalll1ing Commission <br /> directed Staff to prepare an ordinance which would prohibit pawnshops as defined by <br /> Minnesota State Statutes from operating within the City. . <br />
