Case #97-24A, Variance - Side Yard Setback (house addition), Arlyn Solberg, <br /> 3232 North Hamline Avenue <br /> Request. The applicant is requesting approval of a Variance for a side yard setback for a <br /> house addition (three feet proposed, when 10 feet is required) on a single family lot zoned <br /> R-l (Exhibit A). <br /> Background. In November of 1997, the applicant wished to constmct a house addition <br /> (kitchen expansion) to the northeast side of the home. The applicant also wished to construct <br /> . an attached deck directly south of the house addition. The Planning Commission on <br /> November 5, 1997, rccommended denial of the side yard sctback variance for the house <br /> addition and denial of a side yard setback variance for the attached deck. On November 10, <br /> 1997, the City Council denied the side yard setback variance for the house addition and <br /> denied the side yard setback variance for the attached deck. The applicant attended neither <br /> of these meetings, due to that he was out of the country. <br /> The Zoning Ordinancc in Section VIII, E, 4, states: "No application which has been denied <br /> wholly or in part shall be resubmitted for a period of six (6) months from the date of said <br /> order of denial." <br /> The applicant has eliminated the proposed deck from this proposal and has reduced the size <br /> of the house expansion to match up with the existing basement wall which is beneath the <br /> steps to the house. The Statfbelieves that these reductions taken by the applicant minimize <br /> the request to the greatest extent possible. <br /> Deadline for Agency Actions. The City of Arden Hills received the complete application <br /> for this request on March 30, 1998. Pursuant to Minnesota State Statute the City must act <br /> on this request by Friday, May 29,1998 (60 days), unless the City provides the petitioner <br /> with written reasons for an additional 60 day review period. The additional review period <br /> would extend to Tuesday, July 28, 1998. The City may with the petitioners consent extend <br /> the review period beyond the Tuesday, July 28, 1998 date. <br /> . <br />
