<br /> ARDEN HILLS PLANNING COMMISSION - MAY 6. 1998 5 <br /> e CASE #98-14 - ANN STURGEON - 3769 NEW BRIGHTON ROAD - LOT SPLIT- <br /> PUBLIC HEARING <br /> Chair Erickson requested verification of the public hearing notice, Community Development <br /> Director Kevin Ringwald verified notice of public hearing in the Bulletin on April 22, 1998. <br /> Chair Erickson gave an overview of the public hearing process, then opened the public hearing at <br /> 8:17 p.m. <br /> Mr. Ringwald explained the applicant is requesting approval of a lot split to create two parcels on <br /> a 2.29 acre parcel zoned R-2 Single and Two Family Residential District. Mr. Ringwald stated <br /> that the applicant requested approval to split offa westerly 1.6 acres of their property for resale. <br /> The easterly portion of the property consists of the existing house on New Brighton Road. Two <br /> lots in the immediate area have also split off the rear of their property similar to this request. Mr. <br /> Ringwald stated that the northeast comer of the garage which is located adj acent to the north <br /> property line of this parcel provides for only four feet of setback when the minimum required <br /> side yard setback is five feet. The easterly and westerly parcel exceed all code requirements in <br /> terms oflot width, depth and area. <br /> Mr. Ringwald stated that the Staff recommends approval of Planning Case 98-14, Lot Split, <br /> subject to the following conditions: <br /> . l. Provision of the necessary drainage and utility, in a form acceptable to the City Attorney <br /> prior to consideration of this request by the City Council. <br /> 2. Payment of the appropriate park dedication fee. <br /> Chair Erickson and asked if anyone in the audience wanted to speak on behalf of Case #98-14. <br /> No one responded. <br /> Chair Erickson asked if anyone wanted to speak in opposition to Case #98-14. No one <br /> responded. <br /> Hearing no further comments, Chair Erickson closed the public hearing at 8:25 p.m. <br /> Commissioner Sand inquired about the westerly edge of the parcel. Mr. Ringwald explained <br /> there are utility line easements located on the westerly edge. <br /> Commissioner Sand inquired about the likelihood that the lots could accommodate a structure or <br /> house and attract a buyer if the lots are split. Mr. Ringwald stated that it appears that it could <br /> accommodate a house. <br /> Commissioner Larson inquired if there was a potential buyer interested in the existing lots, <br /> including the lot owned by the applicant. <br /> e Ms. Ann Sturgeon, 3769 New Brighton Road, stated that 3 lots, including hers, were <br /> advertised for sale together but one of the owners died. Currently, there are two lots for sale, one <br /> of which is owned by her. <br /> ______..___u_ <br />
