MEMORANDUM <br /> DATE: August 12, 1998 <br /> TO: Brian Fritsinger, City Administrator <br /> FROM: Dwayne Stafford, Public Works Director V~ <br /> SUBJECT: Lake Josephine Ordinance and Joint Power Agreement <br /> Backeround <br /> The Arden Hills Public Works Director presented the City Council a recommendation at their <br /> July 13, 1998 meeting to hold a Public Hearing in the matter of surface water use on Lake <br /> Josephine. Council agreed with the request but asked that the Hearing not be scheduled <br /> concurrent with the Roseville Public Hearing on this matter. This would allow interested parties <br /> the option of attending either one or both Hearings, <br /> Notices of the Public Hearings for both Cities were posted at the Public Access boat landing on <br /> Lake Josephine, as well as mailed to all property owners, officers ofthe Lake Josephine <br /> Improvement Association, and those residents with easements to the Lake, <br /> . Currently the City has no ordinances for surface water use specific to Lake Josephine. <br /> The State has general rules which apply to all State waters addressing licensing, operator age, <br /> personal flotation devices, careless operation, etc.. <br /> On August 10'h, 1998, the Roseville City Council held a Public Hearing on this Matter and <br /> unanimously approved the attached Ordinance, and Joint Powers Agreement, subject to approval <br /> by the Arden Hills City Council and the Minnesota Department of Natural Resources. <br /> Ordinance and Joint Powers ^ereement <br /> The attached Ordinance and Joint Powers Agreement has been provided to Lake Josephine <br /> residents by the Lake Josephine Improvement Association. Those residents have given the <br /> Ordinance and Joint Powers Agreement their unanimous support. <br /> The key points of the Ordinance are as follows: <br /> o Maximum speed limit of 40 mph, 24 hours a day. <br /> o Motor boats and anything towed by motor boats shall operate at a no-wake <br /> speed when operating within 150 feet from shore. <br /> o Motor boats shall travel in a counter-clockwise direction. <br /> o Boaters and those being towed by boats must maintain a safe distance from <br /> other boats, swimmers, docks, etc. <br /> . o Enforcement shall be the responsibility of the Ramsey County Sheriffs Department. <br />
