Case #98-17, Minor Subdivision, Easement Vacation, and Variances, John McClnng, 4326 North Snelling Avenue Request. The applicant is requesting approval of a three (3) lot minor subdivision. The applicant proposes to divide Outlot A, McClung First Addition into three parcels (Exhibit A). Proposed Parcel C contains the existing home ofthe applicant. The applicant is also requesting approval of variances for tbe lot area (195 sq. ft.) and for the lot depth (8.38 feet) on proposed Parcel B and a vacation of part of a utility easement. Background. McClung First Addition was approved on October 16, 1978 (Exhibit B). It . contained 11 lots and Outlot A. The City granted lot depth variances of 1.9 feet were granted for the three lots across McClung Drive from the Outlot being considered in the current application and lot width variances of five feet were granted for two other lots. The drainage easement across portions of Outlot A (as shown attachment 2) now exist in the form recommended by RCWD in 1978. The project file shows that the platting began in November of 1977 and continued through October of 1978. Over this period of time, many options were proposed and discussions with the Planning Commission, City Council, RCWD and City consultants were incorporated into the eventual Final Plat. The applicant came before the Planning Commission with this request as part of Planning Case 96-24 on November 6,1996. The Planning Commission postponed action on this request until such time as a wetland delineation was completed. Subsequent to that action the applicant witbdrew the request. Deadline for Agency Actions. The City of Arden Hills received the complete application for this request on May 28, 1998. Pursuant to Minnesota State Statute, the City must act on this request by Monday, July 27, 1998 (60 days), unless the City provides the petitioner with written reasons for an additional 60 day review period. The additional review period would extend to Friday, September 25, 1998. The City may with the petitioners consent extend tbe review period beyond the Friday, September 25, 1998, date. .
