The Planning Commission, at their July 1, 1998 regular meeting, <br /> approved Planning Case 98-17, Minor Subdivision of Outlot A, McClung First Addition, <br /> easement vacation, and variances (lot depth and area) on Parcel B based on the Findings - Lot <br /> Depth Variance (Parcel B) and Findings - Lot Area Variance (Parcel B) sections of the Staff <br /> Report dated July 1, 1998, subject to the following conditions: <br /> 1. Payment of the appropriate park dedication fee. <br /> 2. Provision of calculations, in a form acceptable to the City Engineer, determining the <br /> appropriate size ofthe replacement area for the easement area which is to be vacated. <br /> 3. Provision of drainage and utility easement in a form acceptable to the City Attorney, <br /> prior to consideration ofthis request by the City Council <br /> 4. Informing the buyer(s) of Parcel A and B, by the applicant, of the restrictions <br /> imposed by the drainage easement in potential building expansion or deck <br /> construction. <br /> 5. Recording the subdivision in the form of a Registered Land Survey. <br /> 6. Provision of the necessary drainage and utility easements along the property lines, <br /> as required by the City Code, in a form acceptable for filing with Ramsey County. <br /> Updates. <br /> Condition #1 The Planning Commission recommendation requires the payment of the . <br /> appropriate park dedication fees. The Community Development Director has prepared a <br /> memorandum regarding the required park dedication fee, which is attached as Exhibit B. <br /> The Community Development Director recommends an additional condition which would <br /> state: "Payment of the park dedication fee shall occur prior to recording of the minor <br /> subdi vision." <br /> Condition #2 The Planning Commission recommendation requires the proVIsion of <br /> calculations for the drainage area that runs through the site in a form which is acceptable to <br /> the City Engineer. The applicants engineer has provided the City Engineer calculations on <br /> the 100 year elevation for this pond. The pond and its new easement is shown on Exhibit C. <br /> The 100 year flood elevation for this pond is at an elevation of915.6. The City Engineer had <br /> accepted the calculations which determined this elevation. <br /> The City Engineer requests that an additional condition be added to the approval of this <br /> request which would require that the lowest floor elevation of homes on Lots A and B be at <br /> least two feet higher than the 100 year flood elevation. Therefore, the City Engineer is <br /> recommending that an additional condition be added which would state: "The lowest floor <br /> elevation for Lots A and B shall be at an elevation no lower than 917.6." <br /> . <br />
