' This Agreement is made and entered into by and between the City of Arden Hills, a Minnesota municipal corporation (the "City") , Frank Rekuski ("R~kuski") and Anthony Andersen I ("Andersen"), to be effective;i:he _ Bday of September, 1998. Recitals A. Andersen is the current fee owner of certain property located at 3171 and 3183 Lexington Avenue, Arden Hills, Ramsey County, Minnesota (t.he "Property"). The legal description of the individual parcels constit.uting the Property are as follows: 3171 Lexinaton Avenue: The North 80 feet of the South 157.4 feet of all that part of the South ~ of Lot 7, Section 34, Township 30, Range 23, lying North of the South 6 acres of said Lot 7, together with and subject to a perpetual right-of-way over than certain roadway running from Lexington Avenue . Westerly toward Lake Josephine at a point approximately 196.45 feet South of the Northerly line of South M of that part of Government Lot 7 lying North of the South 6 acres t.hereof. , .,. 1 3183 LeXlnQton Avenue: The North 80 feet of the South 237.40 feet of that part of Government Lot 7, North of the South Six acres in Section 34, Township 30, Range 23. B. The City commenced a proceeding against the Property pursuant to Minn. Stat. !!l 463.15 et seg., a/k/s the "Hazardous Building Statute" (the "aBS") on August 10, 1998. A full copy of the City's Resolution and Findings, commencing the proceeding, was personally. served upon Andersen on August 17, 1998. The receipt of said Resolution and Findings and valid commencement of the proceeding under the RBS is hereby acknowledged. C. A Notice of Lis Pendens was filed with the Ramsey County . 1 --
