The parties to this Agreement have generally agreed to certain matters in order to facilitate the transfer of the Property from Andersen to Rekuski, protect the interest of the City in the rights which it has obtained as a result of the commencement of the proceeding pursuant to the HBS. F. The parties wish to memorialize their agreement in writing and therefore agree as set forth below. AGREEMENT 1- Obliaations/Role of Andersen. Upon the execution of this . Agreement, Andersen shall pay to the City the amount of , which amount constitutes the approximate amount of the City's expenses chargeable against the Property or the owner thereof pursuant to the Act. It is understood that this figure is a good faith estimate. When the exact amount is calculated , the difference shall be paid by Andersen or reimbursed by the City within five (5) days of notice thereof. The City represents that the final figure will not be in excess of 10% of the figure above. 2. Obliaations/Role of Rekuski. a. Rekuski agrees to be substicuted as and considered the "Owner" of the Property for the purposes of any further action under the Act, and shall be responsible for all of the Owners responsibilities thereunder.
