Case #98-22, Variance - Corner Side Yard Setback (garage detached), Walter and Sandra Schaar, 1932 Glenpaul Avenue Request. The applicant is requesting approval of a comer side yard setback (25 feet proposed, when 40 feet is required) to rebuild an existing garage on a single family lot zoned R-2 (Exhibit A). Background. The applicant currently has a 594 square foot (22 feet by 27 feet) detached garage. The detached garage is currently 13 feet from the West property line, The applicant . wishes to rebuild the existing detached garage at 720 square feet (24 feet by 30 feet). The rebuilt garage requires the comer side yard setback variance (25 feet proposed, when 40 feet is required. Deadline for Agency Actions. The City of Arden Hills received the completed application for this request on August 3, 1998. Pursuant to Minnesota State Statute the City must act on this request by Friday, October 2, 1998 (60 days), unless the City provides the petitioner with writtcn reasons for an additional 60 day review period, The additional review period would extend to Tuesday, December I, 1998. The City may with the petitioners consent extend the review period beyond the Tuesday, December 1, 1998 date, Lastly, if the City denies the petitioners request, ".., it must state in writing the reasons for thc dcnial at the time that it denies the request." Recommendation. The Planning Commission recommends approval of Planning Case 98- 22, Variance, comer side yard setback variance for the detached garage (25 feet proposed when 40 feet is required) based on the "Comer Side Yard Setback Variance (detached . garage)" section of the staff report dated August 20, 1998.
