<br /> 2. Case #98-23, Variance - Corner Side Yard Setback (Three Season Porch), Jeff and <br /> Sandra Kurkowski, 1120 Karth Lake Drive . <br /> Request. The applicant is requesting approval of a comer side yard setback (27 feet <br /> proposed, when 40 feet is required) to build a three season porch addition on a single family <br /> lot zoned R-l (Exhibit B). Secondly, in the event that the house was destroyed, they would <br /> like to ask for a variance allowing the existing home to be rebuilt in its current location. <br /> Background. The proposed three season porch is 13 feet 6 inches by 14 feet 6 inches (196 <br /> square feet). The applicant has evaluated other locations for the porch addition however, this <br /> is the only location they feel will work with the existing home. The house currently has a <br /> side yard setback of 27 feet, where 40 is required. The existing home was built when the <br /> zoning ordinance allowed for a 20 foot comer side yard setback. <br /> Deadline for Agency Actions. The City of Arden Hills received the completed application <br /> for this request on August 5, 1998. Pursuant to Minnesota State Statute the City must act on <br /> this request by Friday, October 2, 1998 (60 days), unless the City provides the petitioner with <br /> written reasons for an additional 60 day review period, The additional review period would <br /> extend to Tuesday, December 1, 1998. The City may with the petitioners consent extend the <br /> review period beyond the Tuesday, December 1, 1998 date, <br /> Lastly, if the City denies the petitioners request, "... it must state in writing the reasons for <br /> the denial at the time that it denies the request." . <br /> Recommendation. The Planning Commission reconunends approval of Planning Case 98- <br /> 23, Variance, comer side yard setback variance for the three season porch (27 feet proposed <br /> when 40 feet is required) based on the "Comer Side Yard Setback Variance (house and <br /> attached porch)" section of the staffreport dated August 25,1998, subject to the following <br /> conditions: <br /> 1. The variance only includes the three season porch addition, <br /> 2. The variance would expire if the porch were to loose its legal nonconforming status. <br /> Note: The Planning Commission is not recommending approval of the variance for the <br /> existing home portion of the request. <br /> Updates. None required, <br /> . <br />
