He suggested that the applicant could withdraw the current plan and <br /> re-submit a new one rather than having it denied. <br /> Mr. Ringwald indicated that there are a variety of options for the applicant. He noted that the six <br /> month waiting period for re-submission to the Council is based only on this request. The <br /> applicant could submit a new request at any time. <br /> Chair Erickson asked, since there is no plan to expand the park, would the City have the option <br /> to re-align the easement to be more consistent with the road. Mr. Ringwald indicated it would be <br /> possible. He noted the issue has not been fully evaluated by the City. <br /> Commissioner Nelson stated that he is not in favor of the request as it was submitted but that <br /> something smaller may be acceptable. Chair Erickson pointed out it is not up to the Commission <br /> to come up with a proposed compromise. They are only able to act on the proposition submitted. <br /> The Commission can make recommendations and suggestions but can only approve or deny the <br /> current request. <br /> Mrs. Dallmann asked that if the Commission makes recommended changes, can the Council <br /> accept or approve the request with the changes. Chair Erickson stated that the Council will . <br /> consider the Commission's recommendations and some requests have been approved, others <br /> denied, and some have been referred back to the Planning Commission. <br /> Mrs. Dallmarm asked if they could be updated as to the status of the road relocation. She noted <br /> that when the idea was presented two years ago, it was to widen the road not move it. Ms. <br /> Randall stated she can check on it but that when she spoke to the Public Works Director, it had <br /> not been approved to be in any particular location. <br /> Commissioner Sand asked if the road is moved, how will it effect the 40 foot setback from the <br /> property line. Ms. Randall stated it would not change the setbacks. Commissioner Sand noted <br /> the issue for the road moving is irrelevant because, even if the road is moved, it will be within <br /> the roadway easement. For this reason it seems to be a visual issue not a legal setback issue. <br /> Commissioner Nelson asked when the City Council will be reviewing this request. Ms. Randall <br /> stated it will be on Monday, October 26, 1998. Commissioner Nelson noted that it is past the <br /> deadline to submit a new plan for that meeting. Ms. Randall stated that an extension will be <br /> requested. She also noted that the other option would be that if the Commission recommends <br /> denial with proposed changes, the applicant could present the changes at the Council meeting. <br /> The Council would have the option to return it to the Planning Commission or, if they are <br /> comfortable with the recommendation of the Commission, they can decide whether or not to <br /> approve the request. <br /> Commissioner Sand asked if the Council were to proceed as Ms. Randall suggested, would they . <br /> be acting on their own analysis. Ms. Randall stated that although the Council would consider the <br /> Commission's recommendation, they would be using their own judgment. They could decide to <br /> return the request to the Commission for its evaluation and recommendation. <br />
