Snelling Avenue, Front Yard Setback <br /> Variance for an attached garage and family room (14 feet proposed, when 40 feet is <br /> required) based on the "Findings-Front Yard Setback Variance (family room and garage)" <br /> section of the staff report dated September 30, 1998. SNELLING A VENUE - MINOR <br /> SUBDIVISION/CONSOI ,IDA nON <br /> Chair Erickson confirmed that the Planning Case was announced in the September 23, 1998 <br /> publication of the Bulletin. He then opened the public hearing at 8:25 p.m. <br /> Mr. Jim Lobinski, 3568 N. Snelling Avenue, indicated that he lives next door to the applicants <br /> from the previous case and stated the flooding problem is ridiculous. He presented a photo <br /> showing the situation between the two houses during the spring time. He stated the l2-inch <br /> drainage pipe has been filled in by development and every time it rains his driveway is <br /> underwater. He feels if the addition for the house next door is approved, the problem will get <br /> worse, particularly if the house is placed away from the street. Chair Erickson asked if the <br /> current owner of the home next door has affected the area. Mr. Lobinski stated that the pipe had <br /> been partially filled in with erosion but his next door neighbor's construction has clogged it <br /> . completely. <br /> Commissioner Sand suggested that Mr. Lobinski address the City Council with this issue or <br /> submit his concerns in writing.. <br /> Councilmember Malone suggested it be reviewed by Public Works staff first. Commissioner <br /> Galatowitsch noted he should make his complaint in writing because, ifhis neighbor's addition is <br /> approved, it may affect his situation. <br /> Chair Erickson requested presentation from Staff on Planning Case #98-26. <br /> Ms. Randall explained that the applicant is requesting approval of a minor subdivision to relocate <br /> a property line between two parcels zoned R-l Single Family Residential. The applicant owns <br /> the two parcels and wishes to move the property line between the two. The lot lines would create <br /> a 2.2 and a 1.1 acre parcel. Parcel number one currently uses an easement through a neighboring <br /> property for access. The subdivision would allow Parcel number one to have right-of-way access <br /> if they so desire. <br /> Ms. Randall advised that Staffrecommends approval of Planning Case #98-26, minor <br /> subdivision, subject to the condition that the subdivision be recorded in the form of a Registered <br /> Land Survey. If the Planning Commission makes a recommendation on the Planning Case, it <br /> would be heard at the Monday, October 26,1998, regular meeting of the City Council. <br /> . Mr. Gregg Larson, applicant, stated he is open to answer any questions. Commissioner Sand <br /> noted that the property on the lake to the south has wooden steps and a deck which are on the <br /> neighbor's existing property line. With the requested change, these structures would be over the <br /> property line onto the applicant's property. Mr. Larson stated that the deck and wooden steps are <br /> not as large as the drawing indicates and were put in by the owners of the house he purchased. <br />
