Ms. <br /> Randall stated she could use more of the interior layout as well as information showing what it <br /> will look like externally. <br /> Commissioner Sand noted a that Certificate of Survey is usually incorporated with the <br /> documents for a setback variance request. He indicated that the drawing is very vague and <br /> sketchy and the submittal should not have been accepted without the Certificate of Survey. <br /> Ms. Randall stated that the original submittal contained drawings ofa square lot and Staff knew <br /> this was incorrect. The drawings had been returned for modification. She also noted that there <br /> are cases when a surveyor cannot get to the site within the time line and the project can be <br /> approved, contingent upon a survey verifying the setback. <br /> Commissioner Sand noted the that applicant seemed to be surprised when he found out how <br /> much of what he thought was his property was actually State owned. He felt that when the <br /> property was purchased, a survey should have been done then and this issue would have been <br /> avoided. Chair Erickson pointed out that there is a Plat from the original subdivision which <br /> shows lot dimensions but does not pinpoint the actual location of the house. <br /> . Commissioner Baker asked how wide the right-of-way at Snelling A venue is and how far away <br /> the home is from the road. Ms. Randall stated that she does not have the exact dimensions and <br /> pointed out the area in question on the map. Mr. Ringwald stated it is approximately 75 feet <br /> from the lot line to the State Highway 51 pavement,. <br /> Commissioner Baker noted that there is a detached garage on the property to the south and asked <br /> if it meets the setback requirement. Mr. Ringwald stated it appears to meet the 40 foot setback. <br /> Commissioner Nelson referred to the suggestion in the Staff report to move the garage back and <br /> asked Ms. Randall to explain how this would work. Ms. Randall stated that one of the ideas was <br /> to move the living area back and have the garage towards the front. If this is done, the addition <br /> would not need to come out quite so far on either side and would most likely meet the required <br /> setback. Commissioner Nelson pointed out that the applicant has already started work on the <br /> garage addition. <br /> Mr. Mike Stephens stated, as Staff indicated, that when he submitted the building permit he <br /> thought it was for the entire addition. He also erred when he assumed the fence along the <br /> property indicated the property line. He noted that the only work that has been done on the <br /> garage addition is the placement of the footings and these can be moved. He does not agree with <br /> the suggestion ofStaffto move the addition back because it will block the family room windows <br /> but he is willing to negotiate something. <br /> . Commissioner Sand asked why the applicant couldn't add onto the house straight to the east <br /> rather than having the angle. Mr. Stephens explained he could but he would only have 20 feet to <br /> work with and that he really wanted more room. He indicated that the house is already long and <br /> adding straight out would cut off his site line. <br />
