Mr. Stephens stated he used the City's drawing and enlarged <br /> it to create the submittal. He indicated that he has had a survey done which shows the property <br /> lines. <br /> Chair Erickson stated that he could not accurately act on the case without knowing the exact <br /> location of the house. He noted all the suggestions being made may not be necessary until this is <br /> known. He does not believe that the drawing the applicant used is completely accurate and <br /> suggested, when the applicant has the survey done, the corners of the house should be staked. <br /> Mr. Stephens asked ifhe could just run a line from the property stakes to the house and make the <br /> measurements this way. Chair Erickson stated, with the rounded corner, it would be difficult to <br /> get an accurate measure. <br /> Commissioner Sand stated, as with the earlier Planning Case, the Commission cannot re-design <br /> on the spot, they must act according to what is presented. He indicated that there are some <br /> options which the applicant could come back with but the Commission will need more accurate <br /> information. <br /> Commissioner Galatowitsch agreed with Commissioner Sand and added that accurate <br /> information is needed to prevent future problems. <br /> Commissioner Nelson showed Mr. Stephens an example of an appropriate survey for submission <br /> with a setback variance request. . <br /> Chair Erickson asked Staff if the City has ever vacated property. Mr. Ringwald stated they have <br /> in certain cases to facilitate development. In this case the road is being used and the City may <br /> not be willing to vacate it. This is a situation in which all the homeowners served by the street <br /> would have to make the request. <br /> Commissioner Galatowitsch asked why the dead end portion of Skiles Lane was constmcted. <br /> Mr. Ringwald stated that it is an access to the two houses on the corners of Glenarden Road and <br /> Skiles Lane. Commissioner Galatowitsch asked what would happen if the City did vacate the <br /> property from the house to the end of the road. Mr. Ringwald stated that the residents would <br /> have to be in agreement and would be responsible to maintain the road. <br /> Commissioner Baker asked if the City were to go this route, how long would the process take <br /> and who would be responsible for the required legal and survey work. Mr. Ringwald stated that <br /> it would be up to the property owners, similar to a request for a lot split or site plan. He noted, <br /> that if the road does not serve the public, the land could go back to the two adjoining property <br /> owners. If the two properties are from the same Plat, the land could be split between them. If <br /> they are from two different Plats, the City would have to determine who originally owned the <br /> land and this is who it would go to.
