Page Three <br /> November 18, 1998 <br /> Upon further discussion with the City Attorney, the City could add language under Section 3.0, <br /> which would require the approval of the extension periods by City Resolution, This language <br /> could read as follows: <br /> 3.0 Term. <br /> The term of this Service Contract shall extend from the first day of January, 1999, until <br /> and through the 31" day of December, 2003 ("Contract Term"). <br /> A. Extended Term, <br /> The term ofthis Service Contract may be renewed for three additional periods <br /> ("Extended Term") of five (5) years each if the City's Council passes a resolution <br /> ("Extension Resolution") by three affirmative votes, expressing the City's intent <br /> to extend the term of the service agreement for an additional five (5)-year period <br /> and communicates such Extension Resolution in writing to the Fire Department at <br /> least one (I) year prior to the end of the Contract Term or any Extended Term. <br /> 1. The first Extended Term shall commence on the I" day of January, 2004, <br /> and shall expire on the 31" day of December, 2008; provided that the City <br /> adopts and communicates the Extension Resolution prior to the 31" day of <br /> . December, 2002. <br /> 2, The second Extended Term shall commence on the 1" day of January, <br /> 2009, and shall expire on the 31" day of December, 2013; provided that <br /> the City adopts and communicates the Extension Resolution prior to the <br /> 31" day of December, 2007. <br /> 3. The third Extended Term shall commence on the 1" day ofJanuary, 2014, <br /> and shall expire on the 31" day of December, 2018; provided that the City <br /> adopts and communicates the Extension Resolution prior to the 31" day of <br /> December,2012. <br /> 8, Termination Resolution, <br /> Notwithstanding the above provisions, this Contract may be terminated by either <br /> party upon the adoption of a Termination Resolution as hereinafter provided, and <br /> communication of such resolution in writing to the other party at least one (1) <br /> year prior to the termination date, <br /> . ".",., <br /> What is the Status of Approvals for these Agreements? <br /> The Cities of North Oaks and Shoreview have both adopted resolutions of support for the Fire <br /> Protection Agreement and Joint Powers Agreement. There are several minor verbiage <br /> amendments that have been suggested by these two cities, but no significant changes or concerns <br /> . were raised. <br />
