<br /> Memorandum, Renewal of Fire Service Agreement <br /> Page Two . <br /> November 18, 1998 <br /> Fire Protection Services Agreement <br /> The model Fire Protection Services Agreement would be entered into individually by each City <br /> with the LJVFD, This agreement has been streamlined significantly from the previous <br /> agreement with the Fire Department. Some of the key provisions ofthe agreement include: <br /> Section 3.0, Term <br /> The initial term of the agreement is five years, with three (3) automatic five (5) year <br /> extensions. <br /> Section 3.0.B, Termination <br /> The Agreement can be terminated by any City or the LJVFD through the adoption of a <br /> termination resolution one year prior to the termination date. <br /> Section 4.0, City Responsibilities <br /> This section identifies the City's goals, including recruitment of firefighters, <br /> compensation, etc, <br /> Section 5.0, I..IVFD Responsibilities <br /> The Fire Department's responsibilities and reporting requirements are defined in this <br /> area, The various reporting requirements have been reduced significantly. . <br /> Section 8.0, Annual Submittals <br /> The agreement requires the submittal of the annual budget and capital improvements <br /> program by July 1" of each year and requires that the City receive a copy of the annual <br /> audit. The payments to LJVFD have been changed from twice per year to quarterly. <br /> Section 12.0, Dissolution <br /> This section requires the LJVFD to amend its by-laws to return all department assets to <br /> the cities in the event that the Department decides to dissolve and a successor <br /> organization is not created. This section has been revised to indicate that there are two <br /> (2) circumstances in which dissolution that may occur. If the dissolution is initiated as a <br /> result of an action taken by one or more of the cities, the Fire Department's assets will be <br /> liquidated and the proceeds would be used to insure that the Fire Department's Relief <br /> Association obligations are fully funded. Any balance would be refunded to the cities, <br /> Have all of the Issues Identified at the Au~ust 19'h .Ioint Meetin~ Reen Addressed? <br /> All of the significant issues identified at the August 19th Joint Meeting with the Cities of North <br /> Oaks and Shoreview, and the LJVFD, have been addressed, Other minor, non-substantial <br /> changes have also been addressed, Section 12,0 has been amended upon further review and <br /> discussion with the Fire Department's attorney, <br /> Councilmember Larson had expressed some concern regarding the length of the Agreement, and <br /> specifically the automatic extensions. There was not consensus at the meeting by the other . <br /> participants that this language be amended, <br />
