<br /> FIRE PROTECTION SERVICE CONTRACT . <br /> CITY OF ARDEN HILLS <br /> LAKE JOHANNA VOLUNTEER FIRE DEPARTMENT <br /> 1.0 Parties. This Contract is entered into by and between the City of Arden <br /> Hills, a statutory city under Chapter 412 of Minnesota Statutes (herein "City"), and the Lake <br /> Johanna Volunteer Fire Department, Inc., a non-profit corporation organized and existing under <br /> the provisions of Chapter 317 of Minnesota Statutes (herein "Fire Department"); and shall be <br /> effective upon approval by both parties. <br /> 2.0 PurDose & Recitals. <br /> A. City is responsible for providing fire protection and prevention services for the <br /> people and institutions situated within its boundaries, which geographic area <br /> shall hereinafter be referred to as the "Fire Service Area". <br /> B. City has authority to enter into this Contract by virtue of provisions of Chapter <br /> 412 ofthe Minnesota Statutes and has determined that the mutual undertakings <br /> set forth in this Contract are desirable, in the public interest, and necessary to <br /> provide forthe public health, safety, and general welfare of the Fire Service Area. <br /> C. Fire Department has provided fire protection and prevention services for the <br /> benefit of the "Fire Service Area" and has the necessary personnel, facilities, . <br /> equipment and training to provide an adequate and reasonable degree of fire <br /> protection and prevention services within the Fire Service Area. <br /> D. Fire Department has authority to enter into this Contract by virtue of the <br /> provisions of its Articles of Incorporation and By-laws and desires to provide City <br /> with fi re protection with i n the Fi re Service Area. <br /> 3.0 Term. The term of this Service Contract shall extend from the first day of <br /> January, 1999, until and through the 31st day of December, 2003, ("Contract Term"). <br /> A. Extended Term. The term of this Service Contract shall be automatically <br /> renewed for three additional periods ("Extended Term") of five years each unless <br /> either party adopts a Termination Resolution at a regular or special meeting of <br /> the City or Fire Department and communicates such resolution in writing to the <br /> .'., other party at least one year prior to the end of the contract term or any <br /> successive extended term. <br /> 1. The first extended term shall commence on the 1st day of January, <br /> 2004, and shall expire on the 31st day of December, 2008. <br /> 1 . <br />
