Commissioner Larson asked if staff is satisfied that the changes needed to be made will be <br /> completed. <br /> Mr. Ringwald stated the developer is moving forward to purchase some required new equipment <br /> and all that is left is the brick work and some landscaping which is just about done. He feels they <br /> are making a serious effort to complete the project and calling every other day to update the staff <br /> on the status of where they are. <br /> The motion carried unanimously (5-0). <br /> B. Tndykiewicz Property, Condemnation/Purchase Update <br /> Mr, Ringwald noted the Indykiewicz's received an Offer Letter from the City on August 27, <br /> 1998, informing them that the City and Ramsey County will be purchasing part oftheir property <br /> (approximately 4.0 acres of a 6.7 acres parcel) for the amount of$350,000, subject to stable soils <br /> and no environmental contamination. Additionally, the City's relocation consultant, Evergreen <br /> Land Services met with the Indykiewicz's on several occasions to provide information on their <br /> relocation benefits. <br /> Mr. Ringwald presented an exhibit showing the alignment of the road going through the property <br /> . which the City Engineer and Ramsey County have agreed will be the minimnrn design <br /> constraints to complete the realignment of Round Lake Road. He pointed out the area south of <br /> the right-of-way has a pond which will accommodate some of the runoff of Highway 96 per <br /> Ramsey County requirements and will also accommodate development on the remnant parcel <br /> with storm drainage. The City Attorney served the Indykiewicz's with a legal Notice of Intent of <br /> the City to acquire property on September 11, 1998. <br /> The property owners have requested the City stake the proposed right-of-way through their <br /> property so they could visualize the impact. The staking, which was to be accomplished <br /> September 11, 1998 has not yet been done. The City Engineer has been asked to have a survey <br /> crew out as soon as possible to stake the right-of-way and to conduct soil borings which will be <br /> coordinated with the Indykiewicz's. <br /> At this point there has not been much discussion regarding the value of the property and it <br /> appears that the City and the land owners vary considerably on the value and whether the <br /> property should be purchased in part or in whole. These issues will continue to be worked on <br /> with the owners. <br /> In relation to the acquisition, staff is preparing a Memorandnrn of Understanding between <br /> Ramsey County and the City. This docnrnent would layout the cost sharing agreement for this <br /> project. There have been verbal agreements made and legal docnrnents are being prepared which <br /> will be forwarded to the Ramsey County Board and the City for their approvals. Ramsey County <br /> . Staff has inform the City that once the design of the road is approved by MNDOT late this <br /> year/early next spring, the County will release the funds to repay the City. Therefore, the <br /> payment schedule should be spring of next year. Ramsey County is to pay for the relocation of <br /> the existing road and the total amount of money has not yet been determined. <br />
