<br />e <br /> <br />e <br /> <br />e <br /> <br />, <br /> <br />The proposed house at 1,440 square feet is a reasonable size home for the <br />neighborhood in which it is located and modest for the community that it is <br />located in. However, the basic question in this request is not whether the home is <br />reasonably sized, but given the extent to which the home is being modified, <br />should the entire house be made to meet the current setback requirements. <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed <br />application for this request on January 13, 1999. Pursuant to Minnesota State <br />Statute, the City must act on this request by Sunday, March 14, 1999 (60 days), <br />unless the City provides the petitioner with written reasons for an additional 60 <br />day review period. The additional review period would extend to Thursday, may <br />13, 1999. The City may, with the petitioners consent, extend the review period <br />beyond the Thursday, May 13, 1999, date. <br /> <br />Lastly, if the City denies the petitioners request, "... it must state in writing the <br />reasons for the denial at the time that it denies the request." <br /> <br />Recommendation. The Planning Commission recornmends denial of Planning <br />Case #98-37, Side Yard Setback Variance (5 feet 1 inches proposed, when 10 feet <br />is required) and a Front Yard Setback Variance (30 feet proposed, when 40 feet is <br />required) for a house addition, based on the "Findings - Front and Side Yard <br />Setback Variance" section of the Staff report dated February 3, 1999. <br /> <br />Updates. The applicant has considered the Planning Commission comments <br />pertaining to demolishing the existing home and building behind the 40 foot <br />setback thus, eliminating the need for the front yard setback. The applicant staked <br />the approximate location of a home behind the 40 foot setback. The applicant has <br />submitted a letter expressing their concerns with removing the existing home and <br />building behind the 40 foot setback. (Attachment B) <br />
