Warran~v of Title. Grantor covenants that it is seized <br />of Parcels A-I and A-2, and that the City shall have the <br />non-exclusive right to use fifty to sixty parking spaces <br />to be allocated and maintained within the Parkin9 <br />Easement during the term and pursuant to the provisions <br />hereof. <br /> <br />I. Naste and Nuisance Prohibited. The City shall comply <br />with all applicable laws affecting the Parking Easement <br />and Access Easement, and shall not commit or suffer to be <br />committed any waste or nuisance on the Parking Easement <br />or Access Easement. <br /> <br />J. Taxes and Assessments. Grantor shall continue to be <br />responsible for the payment of any taxes or assessments <br />on the Parking Easement and Access Easement. <br /> <br />Liens. The City 6hall keep the Parking ,Easement and <br />Access Easement and any ilIIprovements which it constrl1cts <br />thereon free and clear of mechanic liens, material liens <br />and other liens for or arising out of or in connection <br />with work or labor done, services performed or materialG <br />or appliances used or furnished for or in connection with <br />any operations of the City. <br /> <br />L. lnd_ificatioll. of Graat.or. Grantor shall not be liable <br />for any loss, injw:y, death or damage to persons or <br />property which at any time lIlay be suftered or sustained <br />by any person using or occupying the parkinfl Easement or <br />Access Easement and resulting frOlll the negligence of the <br />City or its agents. The City shall not be liable for any <br />loss, injury, death or damage to persons or property <br />which at any tilll. may be suffered or sustained by any <br />person using or occupying the Parking Ea._ent or Access <br />EasSlllent and resulting from the negligence ot Grantor or <br />its agents. . <br /> <br />K. <br /> <br />M. J:nsurlUlce. The City shall, and at its sole expense, <br />include the Parking Basement and Access Bas_nt within <br />its liability coverage.
