<br />;)/q" <br /> <br />. <br /> <br />Back2round <br /> <br />e <br /> <br />The Wetland Conservation Act of 1991 is codified in 1991 Minnesota Statutes, Chapter 354. The <br />The wetland conservation act has been subsequently modified in recent legislative sessions. <br />Board of Water and Soil Resources (BOWSR) has subsequently promulgated rules for <br />administrating the act. The purpose of the Act and Rules is to: <br /> <br />1) Achieve no net loss in quantity, quality and biological diversity of state wetlands; <br /> <br />2) Increase the quantity, quality and biological diversity of state wetlands; <br /> <br />3 ) Avoid impacts that destroy or diminish the quantity, quality and biological diversity of <br />state wetlands; and <br /> <br />4) Replace wetland values where avoidance of impact is not feasible. <br /> <br />Administration and enforcement of the Act is largely the responsibility of the local governing <br />units (City of Arden Illils and Rice Creek Watershed District). Generally, no person shaI1 drain or <br />fill a wetland, wholly or partially, without first having a wetland value replacement plan approved <br />by the governing body of the local governing unit. Wetland areas can be used for pasture or e <br />cropland, provided that the use does not drain or fill the wetland. <br /> <br />MethodolQJY <br /> <br />Wetlands were evaluated according to the criteria defined in the Corns of Ernrlneers Wetlands <br />Delineation Manual (Technical Report Y-87-1). The Minnesota Wetland Delineation Field Guide <br />(1993), which provides useful reference pertaining to Minnesota wetlands, was also used. <br /> <br />Three essential characteristics are required for an area to be defined as a wetland: 1) hydrophytic <br />vegetation, 2) hydric soils, and 3) wetland hydrology. All three of these characteristics must be <br />met, according to the technical criteria for each, for an area to be classified as a wetland. <br /> <br />Wetland delineation methods utilized for this project include on-site procedures. Samples of soil <br />and vegetation are required to make an on-site determination of vegetation, soil type, and <br />hydrology as required to complete the Routine Wetland Detennination fOnD. <br /> <br />e <br /> <br />2 <br />
