The section which he refers to (M.S. 160.05, Subd. 1) <br />does indicate that the City acquires certain rights if they continuously maintain a road for six <br />or more years. However, the Statute only would apply to the improved portion of the right of <br />way. In addition, there is nothing in the Statute which indicates how the City would go about <br />establishing its interest of record. <br /> <br />I indicated to Mr. Miller that he needs to discuss these issues with the adjoining property <br />owners and determine if they are willing to dedicate additional right of way to the City.
