<br />Chapter 3 Licenses and Regulations <br /> <br />2. Consumption of Alcoholic Beverages Prohibited. The consumption of <br /> <br />alcoholic beverages, whether classified as intoxicating or 3.2 malt liquor (beer) <br /> <br />nemintexieatiJ,g, or the use of any controlled substance shall not be permitted on <br /> <br />any part of the premises of the amusement arcade, except that alcoholic beverages <br /> <br />may be served in appropriate sections of bowling alleys as authorized by law. <br /> <br />3. Hours of Operation. On all Saturdays of the year, and on weekdays from and <br /> <br />including June 1st through August 31st, an amusement arcade shall be open only <br /> <br /> <br />between the hours of 8:00 a.m. and 12:00 midnight. On all Sundays of the year, <br /> <br /> <br />and on weekdays from and including September 1st through May 31st, an <br /> <br /> <br />amusement arcade shall be open only between the hours of 3:00 p.m. and 11:00 <br /> <br />p.m. ~: The city can lawfully restrict hours of operation provided that the <br /> <br />hours are designed to prevent a perceived problem or nuisance. The 3 :00 - 11:00 <br /> <br />restriction could be subject to challenge as being unreasonably restrictive, <br /> <br />particularly on Sundays, but it may be possible to show just cause on school days, <br /> <br />If the city has no particular reason for regulating the hours, this section should <br /> <br />be removed or modified. <br /> <br /> <br />4. Supervision. The licensee shall provide a full-time manager of at least <br /> <br />eighteen (18) years of age upon the premises of the amusement arcade during all <br /> <br />hours in which it is open for business. <br /> <br />3 - 28 <br /> <br />I <br />
