The provisions of this Section may be waived by the City Council upon <br /> <br /> <br />recommendation to that effect by the utility committee and upon the finding of the <br /> <br /> <br />Council that either or both of the following are applicable in case of the particular <br /> <br /> <br />application: <br /> <br />1. The placing of electric and telephone utilities underground would not be <br />compatible with the development planned. <br /> <br />2. Unusual topography, soil, or other physical conditions makeuIiderground <br /> <br />installation unfeasible from an engineering viewpoint, or the cost thereof <br /> <br />impractical. <br /> <br />B. Routine maintenance, emergency repairs to existing distribution lines, and <br /> <br />temporary service to a construction project are exempt from submission requirement <br /> <br />of this Subsection. <br /> <br />Subd. 9 Restraining Actions. In the event of a violation or a threatened violation of this <br /> <br />Subsection, the Council, or any member thereof, in addition to other remedies, may institute <br /> <br />10 - 49 <br />
