Post, Interim City Administrato..@J <br /> <br />Paul Malone's Resignation <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Baeke:round <br />Attached, the City Council will find a copy of the letter from Councilmember Malone, resigning <br />from the City Council effective November 30, 1999., <br /> <br />In 1998, with the resignation offormer Councilmember Dale Hicks, the City Council declared a <br />Council vacancy to exist, accepted applications, and appointed an individual to serve tl1e <br />remainder of Councilmember Hicks' term through December 31, 1998. <br /> <br />Considerations <br />Council may again wish to discuss this procedure, as per Minnesota Statute 351.0 I, which <br />addresses the resignation of a Councilmember. A resolution has been prepared for the October <br />25, 1999 regular City Council meeting, declaring that a vacancy exists. A draft ofthe resolution <br />is attached and is required to be adopted for the resignation to be official, and an appointment to <br />be made. <br /> <br />Alternatively, Council may wish to discuss ifit wants to hold a Special Election to fill the vacant <br />Council seat. To the extent that this alternative may take more time than the appointment option, <br />Council should be aware of possible future actions that would require a super majority or a <br />unanimous vote from the four City Councilmembers. <br />
