<br />'" <br />. <br /> <br />. <br /> <br />. <br /> <br />CITY ADMINISTRATOR AGREEMENT <br /> <br />PAGE THREE <br /> <br />In the event the Employee is terminated by the Employer during such time that the <br />Employee is willing and able to perform the duties of City Clerk! Administrator, then in <br />that event, the Employer agrees to continue to provide and pay for the benefits set forth in <br />paragraph "6" above for a period of up to one year following termination, and pay <br />Employee at the time ofreceipt of his last paycheck a lump sum cash payment equal to <br />the following: <br /> <br />First six (6) months <br />Six (6) months to <br />twenty-four (24) months <br />After twenty-four (24) months <br /> <br />Sixty (60) day aggregate salary <br /> <br />Ninety (90) days aggregate salary <br />One hundred-twenty (120) days aggregate salary <br /> <br />In addition to said severance pay, if Employee leaves the employ of the City, the <br />Employee shall be paid for any unused vacation. Compensation shall be given for any <br />unused sick leave in accordance with City policy. If Employee voluntarily resigns his <br />position with the City, the Employee agrees to give the Employer thirty (30) days <br />advance notice. <br /> <br />11. <br /> <br />HOURS OF WORK <br />It is understood that the position of City Clerk! Administrator requires attendance at <br />evening meetings and occasionally at weekend meetings. It is understood that employee <br />may be absent from the office to a reasonable extent in consideration of extraordinary <br />time expenditures for evening and weekend meetings at other than normal working hours. <br /> <br />12. AUTOMOBILE <br />Employee shall be paid $275.00 per month to use his personal automobile for City <br />business within the Twin Cities metropolitan area. During the Employee's first six (6) <br />months of employment, Employer shall reimburse Employee for any down payment or <br />up front costs associated with the acquisition of a personal vehicle, with such <br />reimbursement being limited to a maximum of twenty percent (20%) of the vehicle's fair <br />market value. Said monthly allowance shall be subject to change upon mutual consent of <br />Employee and the Employer. This amount will be reviewed at the performance and <br />salary review dates. <br /> <br />13. GENERAL CONDITIONS OF EMPLOYMENT <br />If any provision, or any portion thereof, contained in this agreement is held to be <br />unconstitutional, invalid or unenforceable, the remainder of this agreement, or a portion <br />thereof, shall be deemed severable, shall not be affected, and shall remain in full force <br />and effect. <br /> <br />14. INDEMNIFICATION <br />Employer shall defend and indemnify Employee, pursuant to Minnesota Statutes 9 <br />466.07 and 465.76. <br />
