The applicant is requesting approval of a corner side yard setback variance (13 <br />feet proposed, when 40 feet is required) and an accessory structure rear yard setback (6 <br />feet proposed, when 10 feet is required) for a new garage on a single family lot zoned R-2 <br />(Exhibit A). <br /> <br />Background. The applicant currently has a two car garage 24 feet by 28 feet (672 square <br />feet). The applicant believes the garage is 13 to 15 feet from the West property line <br />(comer side) and 10 feet from the North property line (rear). Staff however, believes the <br />garage is only six feet from the rear property line where 10 feet is required. The <br />applicant wishes to demolish the existing garage and rebuild the detached garage in the <br />same location and the same size. <br /> <br />Currently there is a large tree to the rear of the garage. This causes some difficulty in <br />moving the garage back further form the street. Prior A venue dead ends at the north end <br />oftheir property line and is only used by two homes and trial access to Hazelnut park. <br /> <br />The applicant could request a vacation, however; the City would still want to keep a trail <br />easement and the applicant would still need a variance for the proposed garage. <br /> <br />The applicant could, however, minimize this request by reducing the garage depth to a <br />standard 22 feet and then only need a 19 foot variance where 40 feet is required. If the <br />setback to the north is less than 10 feet the applicant could move the garage to the south <br />to eliminate the need for a variance. <br /> <br />Findinl!:s - Corner Side Yard Setback and Rear Yard Accessory Strncture Setback <br />Variance <br />The Staff concludes that the following factors relate to the requested variance: <br /> <br />1. <br /> <br />Circumstances Unique to the Property: The property in question is approximately <br />10,125 square feet in area on the comer of Jerrold Avenue and Prior Avenue. <br /> <br />The proposed garage is 24 feet by 28 feet in size (672 sf in area). The property <br />width is 85 feet. In addition, there is a significant tree just to the East of the <br />proposed garage. <br />
