<br />2. Minimization ofrequest: The applicant could reduce the garage depth to a standard <br />22 feet and than only need a 19 foot variance where 40 feet is required. The <br />applicant could move the garage to the south to eliminate the need for a variance to <br />the north. <br /> <br />II <br /> <br />3. Variance would allow a condition that is consistent with the surrounding <br />development: The proposed detached garage is close to a property line. Garages on <br />lots in the surrounding area are closer than the ordinance allows. <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed <br />application for this request on September 7, 1999. Pursuant to Minnesota State Statute, <br />the City must act on this request by Friday, November 5, 1999 (60 days), unless the City <br />provides the petitioner with written reasons for an additional 60-day review period. The <br />additional review period would extend to Tuesday, January 4, 2000. The City may, with <br />the petitioners consent, extend the review period beyond the Tuesday, January 4, 2000 <br />date. <br /> <br />Lastly, if the City denies the petitioner's request, "...it must state in writing the reasons for <br />the denial at the time that it denies the request." <br /> <br />Recommendations. The Planning Commission recommends approval of Planning Case <br />#99-18, Comer Side Yard Setback Variance (13 feet proposed, when 40 feet is required) <br />for a new garage, conditioned on: <br /> <br />-- <br /> <br />1. The northern accessory structure setback be the required 10 feet rather than the <br />requested six feet by moving the garage to the south. <br /> <br />2. The dimensions of the new garage be the same or smaller than the existing garage <br />being replaced. <br /> <br />Updates. The letter from the applicant has handed out at the October 6,1999, Planning <br />Commission meeting.
