<br />Findinl!:s - Corner Side Yard Setback and rear vard Accessory Setback Variance <br />The Staff would conclude that the following factors relate to the requested side yard <br />setback variance: <br /> <br />1. Circumstances Unique to the Property: 1609 Lake Johanna Boulevard is not <br />located on a public street. The side needing a variance for 1605 Lake Johanna <br />Boulevard is not a public street and if it were viewed as such would only require a <br />10 foot side yard setback. Only four lots access this area. <br />The property west of the subject lots is owned by Ramsey County and is part of <br />the Ramsey County Open Space. It is reasonable to expect that this will remain as <br />permanent open space. <br /> <br />The lots are smaller than the mlmmum R-l zoning requirements making it <br />difficult to construct a home of average size on the lot. The pool and basketball <br />court make it difficult to move the homes further back. <br /> <br />2. Variance would allow a condition that is consistent with the surrounding <br />development: Two houses to the north were granted variances for a 20 and 25 <br />foot setback to the front property line. The lots to the north are wider and were <br />able to locate the homes at an angle (Exhibit D). <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed <br />application for this request on September 9, 1999. Pursuant to Minnesota State Statute, <br />the City must act on this request by Monday, November 8, 1999 (60 days), unless the <br />City provides the petitioner with written reasons for an additional 60-day review period. <br />The additional review period would extend to Friday, January 7, 2000. The City may, <br />with the petitioners consent, extend the review period beyond the Friday, January 7, <br />2000, date. <br /> <br />Lastly, if the City denies the petitioner's request, "...it must state in writing the reasons for <br />the denial at the time that it denies the request." <br /> <br />Recommendations. The Planning Commission recommends approval of Planning Case <br />#99-19, Front Yard Setback Variance, as modified by the applicant to 20 feet proposed, <br />when 40 feet is required, for placement of two single family homes at 1605 and 1609 <br />Lake Johanna Boulevard, subject to these properties meeting all other side and rear <br />setback requirements <br /> <br />Updates. Staff modified the originally proposed plan to show a 20 foot front yard setback <br />as agreed upon by the applicant at the Planning Commission meeting. <br /> <br />-- <br /> <br />-- <br /> <br />-- <br />
