<br />Metropolitan Land Planning Act <br /> <br />Under the Metropolitan Land Planning Act of 1976, the Metropolitan Council is required to review Arden Hills's <br />Reuse Plan for TCAAP to ensure its consistency with metropolitan system plans for sewer and water service, transit, <br />parks and open space, and affordable housing. The plan must receive approval from the Metropolitan Council <br />before the City Council implements the TCAAP Reuse Plan through zoning. The City's zoning provisions must then <br />be made consistent with the approved TCAAP Reuse Plan. <br /> <br />Metropolitan Significance Rules <br /> <br />TCAAP is one of three or four intact remaining parcels of land within the Metropolitan Urban Services Area <br />(MUSA) that might qualify for designation as "regionally significant". Such a designation would be based on the <br />parcel's location, size, and ultimate development potential. The last site declared to have regional significance is the <br />site now occupied by the Mall of America in Bloomington. <br /> <br />The Metropolitan Council bas the authority to initiate a process to determine whether a land development project is <br />of such magnitude that it has regional significance -- that is, it cause regional impacts on metropolitan systems such <br />as transit service, highways, sewer and water service and parks and open space. <br /> <br />The Met Council can initiate such a review in response to a request from any of the following: <br />An affected local governmental unit; <br />A petition signed by 5,000 Twin City residents; or <br />A letter from a state agency. <br /> <br />If the Metropolitan Council determines that a project may have metropolitan significance, it can order that the <br />project be suspended pending resolution of the review process. <br /> <br />Formal review of metropolitan significance may consist of mediation, a contested case proceeding, a public bearing <br />or some version thereof. Ultimately, the matter will be reviewed by the full Council to determine the outcome of the <br />question. <br /> <br />If the Metropolitan Council fmds a project to be of metropolitan significance because it affects regional systems, the <br />Council can order that the project be suspended for up to one year, unless disputed issues can be resolved in the <br />interim. <br /> <br />If TCAAP is excessed in pieces, and subsequently developed in stages, it may fail most metropolitan significance <br />tests. However, the sheer size of the property -- nearly four square miles .. suggests that a fmding of metropolitan <br />significance would not be out of the question. <br /> <br />Camiros, LtdjSEH.
