IfTCAAP is sold outside the federal government, the <br />ultimate user must comply with Arden Hills plauning and zoning standards. The GSA must also consider the <br />capacity of the nominee to [mance and operate the property for the purpose stated in the application. <br /> <br />The Departments of Health and Human Services and Housing and Urban Development (HUD) are required by the <br />McKinney Act to periodically survey all Federal agencies to identify land that is presently or soon to be declared <br />excess or surplus. A determination must be made for each identified parcel as to whether the property is suitable for <br />use as a homeless shelter. If a property is suitable, HUD may file an application to transfer the property to a <br />nominee seeking to operate a sbelter for the homeless. (Note: A statement that the property encompassing the <br />TCAAP residences is "unsuitable" for use as a homeless shelter has been published in the Federal Register since <br />about 1991.) <br /> <br />If no authorized claim is made by any agency on bebalf of a nominee, the GSA will have to attempt to dispose of <br />TCAAP by advertised sale or negotiated sale. In either instance, the GSA is obligated to seek fair market value for <br />the land. Ordinarily, a public bid process is required to dispose of surplus land, and the land is sold to the interest <br />making the highest bid. <br /> <br />Negotiated sales are allowed only if: <br />~ bid prices are umeasonable, <br />. the character or condition of the property makes it impractical to advertise for bids, or <br />. when satisfactory terms can be obtained through a sale to a state, regional, county or local government. <br /> <br />2. Minnesota Land Planning Regulations <br /> <br />The State of Minnesota has imposed planning regulations and guidelines both generally, state-wide, and <br />specifically, through the Metropolitan Council within the Twin Cities Metropolitan Region. All of these regulations <br />will have some effect on reuse plauning for TCAAP. <br /> <br />Minnesota Land Planning Act <br /> <br />In Minnesota, a comprehensive municipal plan typically includes policy goals, standards, and maps that incorporate <br />a land use plan, community facilities plan and transportation plan. This plan document provides the foundation for <br />all other local land-use regulatory efforts, including adoption of a zoning ordinance and subdivision code. The City <br />of Arden Hills has had a comprehensive plan since the I 960s. The existing plan will have to be amended to reflect <br />proposed changes in the future use of TCAAP. <br /> <br />The Planning Commission has statutory responsibility, via delegation by the City Council, to create and the Plan as <br />needed. A proposed Plan or related amendments may not be acted upon by the City Council until it has received the <br />recommendation of the Plauning Commission (or until 60 days have elapsed from the date an amendment was <br />submitted by the City Council for Plauning Commission review). <br /> <br />The City can adopt an interim development moratorium to protect its planning process at any time. The initial <br />moratorium can last for up to 12 months and may be extended for additional periods up to a total ofadditional18 <br />months. <br /> <br />Once the plan has been adopted, the Plauning Commission may prepare and recommend for adoption by the City <br />Council implementation measures relating to the Plan, including zoning regulations, subdivision regulations, an <br />official map, a program for coordination of normal public improvements and services, urban renewal and/or a <br />capital improvements program. <br /> <br />Camiros, Ltd.lSEH, Inc./LHDL.
