<br />~ <br />.r <br /> <br />.1 <br />J <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />JOINT POWERS AGREEMENT <br />CITY OF ARDEN HILLS AND <br />STATE OF MINNESOTA DEPARTMENT OF MILITARY AFFAIRS <br /> <br />THIS JOINT POWERS AGREEMENT ("Agreement") is made and entered into as of the <br />day of , 2000, by and between the City of Arden Hills ("City") <br />and the State of Minnesota Department of Military Affairs ("National Guard") through the <br />Adjutant General of Minnesota. <br /> <br />WHEREAS, the Congress of the United States of America has authorized the Secretary of <br />the Army to convey to the City a parcel of real estate ("parcel"), located in the area known as the <br />Twin Cities Army Ammunition Plant, for the purpose of constructing a city hall complex. The <br />legislation setting out this authorization is set out in attachment A, which is incorporated herein <br />by reference. Attachment B, which is incorporated herein by reference, more completely <br />describes the parcel; and <br /> <br />WHEREAS, city intends, subject to availability of funds, to construct a city hall complex on <br />the parcel; and <br /> <br />WHEREAS, Congress provided that, as consideration for conveyance of the parcel, the City <br />should make portions of the city hall complex available to the Minnesota National Guard for <br />public meetings and as detailed in agreements entered into between the City and the Adjutant <br />General of Minnesota; and <br /> <br />WHEREAS, the City and National Guard want to enter into an agreement setting out the <br />National Guard's use ofthe city hall complex as provided for by Congress as the required <br />consideration for transfer of the parcel to the City and further delineating the relationship of the <br />parties relative to that use of the city hall complex; and <br /> <br />WHEREAS, Minnesota Statutes S 471.59 provides the parties the authority to enter into this <br />agreement; <br /> <br />NOW THEREFORE, in consideration of the transfer of the parcel to the City and also in <br />consideration of the mutual promises and convenants of the parties to each other contained in <br />this agreement and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br /> <br />I. Purpose. <br /> <br />The agreement defines the rights and responsibilities of the City and National Guard relative <br />to the National Guard's use of portions ofthe City facilities being constructed on the parcel. <br />
