~ .r .1 J e e e JOINT POWERS AGREEMENT CITY OF ARDEN HILLS AND STATE OF MINNESOTA DEPARTMENT OF MILITARY AFFAIRS THIS JOINT POWERS AGREEMENT ("Agreement") is made and entered into as of the day of , 2000, by and between the City of Arden Hills ("City") and the State of Minnesota Department of Military Affairs ("National Guard") through the Adjutant General of Minnesota. WHEREAS, the Congress of the United States of America has authorized the Secretary of the Army to convey to the City a parcel of real estate ("parcel"), located in the area known as the Twin Cities Army Ammunition Plant, for the purpose of constructing a city hall complex. The legislation setting out this authorization is set out in attachment A, which is incorporated herein by reference. Attachment B, which is incorporated herein by reference, more completely describes the parcel; and WHEREAS, city intends, subject to availability of funds, to construct a city hall complex on the parcel; and WHEREAS, Congress provided that, as consideration for conveyance of the parcel, the City should make portions of the city hall complex available to the Minnesota National Guard for public meetings and as detailed in agreements entered into between the City and the Adjutant General of Minnesota; and WHEREAS, the City and National Guard want to enter into an agreement setting out the National Guard's use ofthe city hall complex as provided for by Congress as the required consideration for transfer of the parcel to the City and further delineating the relationship of the parties relative to that use of the city hall complex; and WHEREAS, Minnesota Statutes S 471.59 provides the parties the authority to enter into this agreement; NOW THEREFORE, in consideration of the transfer of the parcel to the City and also in consideration of the mutual promises and convenants of the parties to each other contained in this agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: I. Purpose. The agreement defines the rights and responsibilities of the City and National Guard relative to the National Guard's use of portions ofthe City facilities being constructed on the parcel.
