<br />State of Readiness meaJ1S a driver who is on call, ready to be dispatched, to perform <br />safety sensitive functions while on duty. <br /> <br />e <br /> <br />Substance Abuse Professional (SAP) means a licensed physiciaJ1 or a licensed or <br />certified psychologist, social worker, employee assistaJ1ce professional, or addiction <br />counselor (certified by the National Association of Alcoholism aJ1d Drug Abuse <br />Counselors Certification Commission) with knowledge of aJ1d clinical experience in the <br />diagnosis aJ1d treatment of alcohol aJ1d controlled substaJ1ces-related disorders. <br /> <br />Supervisor meaJ1S the person designated by the City to perform supervisory functions <br />over the City's drivers. <br /> <br />Violation Rate meaJ1S the number of drivers found during raJ1dom tests given purSUaJ1t to <br />this policy aJ1d federal regulations to have aJ1 alcohol concentration of 0,04 or greater, plus <br />the number of drivers who refuse a raJ1dom test required by this policy aJ1d federal <br />regulations, divided by the total reported number of drivers in the industry given raJ1dom <br />alcohol tests purSUaJ1t to this policy aJ1d federal regulations, plus the total reported number <br />of drivers in the industry who refuse a raJ1dom test required by this policy aJ1d federal <br />regulations. <br /> <br />CIRCUMSTANCES UNDER WHICH <br />DRUG AND ALCOHOL TESTS SHALL BE REQUIRED OR REQUESTED <br /> <br />. <br /> <br />DURING THE APPLICATION PROCESS <br />All job applicaJ1ts, including persons currently employed by the Employer, applying for a job <br />where duties include operating the Employer CMV's are required to undergo testing for alcohol <br />aJ1d drugs if a job offer is made, The job offer is contingent upon a negative drug aJ1d alcohol <br />test report aJ1d the applicaJ1t's written agreement authorizing former employers to release to the <br />Employer all information on the applicaJ1t's alcohol tests with a concentration result of 0.04 or <br />greater, positive controlled substaJ1ces test results, aJ1d refusals to be tested, within the preceding <br />two (2) years, <br /> <br />REASONABLE SUSPICION <br />A drug test shall be required if the Employer has a reasonable suspicion that aJ1 employee has <br />violated the provision ofthis policy regarding alcohol or controlled substaJ1ces, Reasonable <br />suspicion alcohol tests should be administered as soon as practicable, If the test is not <br />administered within two (2) hours, the reason shall be documented. <br /> <br />If the alcohol test is not administered within eight (8) hours, all attempts to conduct the test shall <br />cease aJ1d the reasons shall be documented. NotwithstaJ1ding the absence of a reasonable <br />suspicion alcohol test, the employee shall not be permitted to perform or continue to perform <br />safety-sensitive functions until twenty-four hours have elapsed following the determination of <br />reasonable suspicion. <br /> <br />. <br /> <br />6 <br />
