Therefore, <br />the Staff is comfortable with the setback being provided. <br /> <br />14. Grading. The applicant has provided a grading, drainage and erosion control plan for the <br />proposed building. The Rice Creek Watershed District (RCWD) has approved the <br />proposed grading plan (Exhibit E). <br /> <br />The development of this site will disturb more than five (5) acres ofland. Therefore, the <br />developer is required to receive a General Construction Storm Water Permit from the <br />Minnesota Pollution Control Agency (MPCA). These permits are required pursuant to <br />the National Pollutant Discharge Elimination System (NPDES) which is administered by <br />the Federal Environmental Protection Agency (EPA). The purpose of the permit is to <br />ensure that the grading plan includes and that the contractor carries out Best Management <br />Practices (BMP's), as it pertains to erosion and sediment control. <br /> <br />e <br /> <br />The City Engineer has reviewed the grading plans and has offered his comments (Exhibit <br />F). The City Engineer has raiscd several concerns and points of clarification regarding <br />the grading plan. The applicant is in the process of preparing a reply to this letter and it <br />will be available for your deliberations. The applicant did respond to one of the City <br />Engineers points of clarification regarding the location of a particular easement (Exhibit <br />G). <br /> <br />15. <br /> <br />U.S. Army Pipeline Easement. The U.S. Army currently has a pipeline (12 inch- <br />natural gas) easement through the western portion of the Phase II property. The pipeline <br />supplied natural gas from Minneapolis to the Twin Cities Army Ammunition Plant <br />(TCAAP). The U.S. Army no longer requires thc pipeline and is in the process of <br />vacating the easement. <br /> <br />. <br />
