<br />ARDEN HILLS PLM1NING COMMISSION - September 6, 2000 <br /> <br />8 <br /> <br />As stated in her letter, the property owner has been operating Always Wood Flooring at this <br />location for almost three years. Prior to this, she was operating the same business in Shoreview e <br />for seven years. The business furnishes materials for wood floors, installs and repairs, resands <br />and finishes existing wood flooring and does maintenance coating for wood flooring. The <br />business owns a total of six vehicles with a working crew of seven people plus one office person. <br />Work is done off-site with the exception of a part-time office person who offices on-site. <br /> <br />From tbe general requirements for all businesses, as stated in the Zoning Ordinance, the <br />following can be detennined: <br /> <br />1. It shall not result in traffic, parking, noise, light, fumes and odors to such an extent that it is <br />noticeable that the property is being used for non-residential purposes. <br />Complaints have been taken on this property because it was obvious that a home business was <br />operating on the premises by the number of vehicles /business vans parked in the front yard. This <br />property does not meet this requirement because the business is noticeable. <br /> <br />2. It shall be conducted entirely within the dwelling. <br />Work is conducted off site with the exception of office work that occurs in the living room area <br />of the home. No part ofthis business operated outdoors on site. <br /> <br />3. There is no exterior evidence of the home occupation. <br />There is exterior evidence of the occupation through the various vehicles on the property used for <br />the business. This property doesn't meet this requirement. <br /> <br />e <br /> <br />4. It does not require any special entrances to the dwelling. <br />No special entrances or modifications to the house are required for this business. <br /> <br />From the specific requirements for a Class II Home Occupation, as stated m the Zoning <br />Ordinance, the following additional information can be determined: <br /> <br />1. The primary business activity shall be conducted by an occupant of the residence; <br />The owner of the company does live on site. Therefore, the primary business activity IS <br />conducted by an occupant of the residence. <br /> <br />2. One person not residing in the residence may be employed to assist in the business activity; <br />More than one person not residing in the home is employed at this business. There is one part <br />time office staff person in addition to a crew of seven who work off-site. Although it could be <br />argued that the seven employees are not on-site at all during the day, they are still employed with <br />the company and assist with the business activity. Plus, they do come to the home at a minimum <br />of twice a day to pick up and return a work vehicle. <br /> <br />3. It does not occupy more than thirty-three (33 percent) of the floor area of the dwelling; <br />According to the applicant's plans, the office portion of the house is approximately 23% which is <br />less than the maximum required of33%. <br /> <br />4. It has a limited number of patrons visiting the premises; . <br />The applicant has stated that it is rare for a customer to come to the home. It is presumed that <br />there isn't traffic from this type of activity very often. <br />
