<br />proposed to be located within the front yard setback of the principal building. The <br />Zoning Ordinance states that acccssory structures are pcrmitted in the rear yard and <br />within any area that is not nearer the front lot line than the front yard setback linc for the <br />principal structure to which it is accessory. The gazebos, although located on the side <br />yard of the property, are actually to the rear of the principal building. <br /> <br />e <br /> <br />The setback for accessory structures within either the side yard or the rear yard is 10'. <br />The proposed positioning of the gazebos exceed this considerably. The Williamsburg is <br />approximately 223' (-30' from the principal building) and the Victorian is 94' (-112 <br />from the building) from the side lot line according to the property survey. Also, the <br />areas of both gazebos are less than the maximum arca permitted for an accessory <br />structure. <br /> <br />The proposed gazebos meet all ofthe minimum requirements for accessory structures <br />outlined in the City of Arden Hills' Zoning Ordinance, Section VI, A. <br /> <br />Deadline for Al!encv Actions <br />The City of Arden Hills received the completed application for this request on September <br />7,2000. Pursuant to Minnesota State Statue, the City must act on this request by <br />November 6,2000 (60 days), unless the City provides the petitioner with written reasons <br />for an additional 60-day reyiew period. The additional review period would extend to <br />January 5, 2001. The City may, with the petitioners consent, extend the review period <br />beyond the, January 5, 2001 date. <br /> <br />e <br /> <br />Lastly, if the City denies the petitioners request, ".. .it must state in writing the reasons for <br />the denial at the time it denies the request." <br /> <br />ODtions <br />I. Table for additional information. <br /> <br />Recommendations <br />The Planning Commission recommends approval of a Planned Unit Development <br />amendment to North Heights Lutheran Church, located at 1700 Highway 96, for the <br />addition of two accessory structmes (gazebos) on the southwest portion of the property, <br />as outlined in the submitted plans, with the following condition: <br /> <br />I.
