The Williamsburg gazebo is approximately 676 square feet in area whereas <br />the Victorian is 168 square feet. The gazebos are considered acecssory to the principal structurc <br />on the property and are, therefore, being evaluated according to accessory structure regulations. <br /> <br />Ms. Chaput stated that the Zoning Ordinmlce does not currently limit the number of accessory <br />structures on a property. Therefore, the addition of two is permitted. Thcy also do not exceed <br />the height of thc principal structure, nor do they exceed the height permitted by the Zoning <br />Ordinance of35'. The gazebos are located in the side yard of the property and are not proposed <br />to be located within the front yard setback of the principal building. The Zoning Ordinance <br />states that acccssory structures are permitted in the rcar yard and within any area that is not <br />nearer the front lot line than the front yard setback line for the principal structure to which it is <br />accessory. The gazebos, although located on the side yard of the property, are actually to thc rear <br />ofthc principal building. <br /> <br />Ms. Chaput stated that the setback for accessory structures for within either the side yard or the <br />rcar yard is 10'. The proposed positioning of the gazebos exceed this considerably. The <br />Williamsburg is approximately 223' (-,30' from the principal building) and the Victorian is 94' <br />(~112 from tlle building) from the side lot line according to the property survey. Also, the areas <br />of both gazebos are less than the maximum area permitted for an accessory structure. <br /> <br />Ms. Chaput stated that the proposed gazebos meet all of the minimum requirements for accessory <br />stmctures outlined in the City of Arden Hills' Zoning Ordinance. <br /> <br />Ms. Chaput stated that the Plamling Commission recommends approval of a P1mmed Unit <br />Development amendment to North Heights Lutheran Church, located at 1700 Highway 96, for <br />the addition of two accessory structures (gazebos) on the southwest portion ofthc property, as <br />outlined in thc submitted plans, with the following condition: <br /> <br />I. Application for a huilding permit must be made with the Building Inspector prior to <br />construction. <br /> <br />MOTION: <br /> <br />Councilmember Grant moved and Councilmcmber Aplikowski seconded a motion <br />to approve Planning Case #00-36, Planned Unit Development amendment to <br />North Heights Lutheran Church, located at 1700 Highway 96, for the addition of <br />two accessory structures (gazebos) on the southwest portion of the property, as <br />outlined in the submitted plans, with the following condition: <br /> <br />1. Application for a building permit must bc made with the Building <br />Inspector prior to construction. <br /> <br />The motion carried unanimously (5-0). <br />
