<br />. <br /> <br />e <br /> <br />CITY OF ARDEN HILLS <br />AGREEMENT FOR CURBSIDE RECYLING SERVICES <br /> <br />Agrccment made as of January 1,2001, benveen the City of Arden Hills, (hereafter the <br />City) and E-Z Recycling, Inc., a Minnesota Corporation (hereafter thc Contractor). <br /> <br />The City and the Contractor agree as follows: <br /> <br />1. Definitions <br /> <br />1.1 "Area" means the entire area of the City of Arden Hills. <br /> <br />NOTE: All boundaries, unless otherwise noted, fall in the centcr of City streets such that <br />they include residents in the one-half of the named street. <br /> <br />1.2 "Recyclable Materials" means newsprint and non-glossy paper, cardboard, <br />glass bottlcs and jars, mixed aluminum and bimetal bcverage containers, <br />aluminum, "tin" food cans, plastic bottles, magazines, box boards, non- <br />hazardous completely drained aerosol cans, miscellaneous metals and other <br />materials as mutually agreed upon by the City and the Contractor. <br /> <br />. <br /> <br />1.3 "Recycling Collection" means the taking up of all recyclable materials <br />aceumulatcd at residential properties (including multi-unit dwellings and <br />apartments, up to 24 units) and the transporting of the rceyclable materials <br />to a site where they can be processcd for the marketplace. This site shall be <br />at an area designated by the Contractor, <br /> <br />2, Scrvices to be Perfomled <br /> <br />2.1 The frequency of collection of recyclab1es shall occur once each week in <br />both of the City's two zones. Zone 1 is that portion of the City located south <br />ofIntcrstate 694. Zone 2 is that portion of the City located north of <br />Interstate 694. Collection in Zone 1 will be on Tuesday of each week and <br />collection in Zone 2 will be on Wednesday of each week, unless the <br />designated collection day is a holiday in which event collection may occur <br />on the day following the holiday. <br /> <br />2.2 The tenns ofthis Agreement shall be from January 1,2001 through <br />December 31, 2001. <br /> <br />. <br /> <br />2.3 The City and the Contractor acknowledge that timcly performance of <br />collcction scrvices is essential to the success of the recycling program. The <br />work shall be done with forces which are adequate to insure the satisfactory <br />collection of disposal of said materials at all times and failure to perform <br />may be excused only by advcrsc conditions of weather and similar <br />hindrances which in other work might be regarded as "act of providence".
