<br />. <br /> <br />e <br /> <br />e <br /> <br />ARDEN HILLS PLANNING COMMISSION - NOVEMBER 1, 2000 <br /> <br />5 <br /> <br />7, <br /> <br />Big Ten Supper Club - 4703 Highway 10 <br /> <br />Ms, Chaput stated that Section Vlll, D of the City's Zoning Ordinance outlines the procedural <br />requirements for zoning ordinance amendments and rezonings. Public hearing notices have hccn <br />published in the legal paper and sent to all property owners within 350 feet of each property in <br />question. By ordinance, rczoning requires consistency with the Comprehensive Plan as well as <br />other more specific criteria for busincss and industrial district rezonings. <br /> <br />Ms. Chaput stated that rezoning propel1ies requirc that the proposed rezoning be consistent with <br />the Comprehensive Plan, The Comprehensive Plan statcs the following rcgarding Neighborhood <br />Business: "Neighborhood Business designates small, isolated areas for neighborhood commercial <br />land uses when they are compatible with surrounding residential uses. Commercial uses that are <br />high traffic generators, noise generators or otherwise not compatible with residential <br />ncighborhoods, are inappropriate. Typically Neighborhood Business areas will be located on <br />intcrscctions or nodes that arc on the edge of residcntial areas, are not desirable sjtes for housing <br />or have traditionally been occupicd with neighborhood services." <br /> <br />Ms. Chaput stated that the language for this district was created simultaneously with the <br />idcntification ofthe properties that would fit into this district. All of the properties in question are <br />individual or small clusters of properties within residcntial areas that are currently, have been <br />used or are better served as busincss sites. They meet the intent of the district and the <br />Comprehensive Plan. <br /> <br />Ms. Chaput stated that the Zoning Ordinance also states that all business and industrial district <br />rezonings must, ",.. be located adj acent to an arterial or collcctor road as shown on the <br />Comprehensive Development Plan, or the rezoning will be an extcnsion of an existing business <br />or industrial district.,." Although not one of the properties being proposed can be considered an <br />extension of an existing business or industrial district, each of them is situated along a major <br />roadway. Thcrefore, each property meets this requiremcnt. <br /> <br />Ms, Chaput stated that staff recommends approval of Planning Case #00-38, amending Section <br />IV (A) of the Zoning Ordinance #291, Zoning Map, to include the Neighborhood Business <br />District as shown in the proposed Zoning Map, dated November 1,2000, in Exhibit A of the staff <br />memo dated October 23, 2000. <br /> <br />Ms, Chaput noted that the proposed zoning map does not have a Civic Center District as it is not <br />completely up to date, <br /> <br />Grant Lindimer, a representative of Lindy's, Inc., stated he is a Managing Partner of Lindimer <br />Partnership which was established by his parents in 1958. He exprcssed his objection to the <br />zoning ordinance amendment which would change thc zoning of Lindy's from its CUlTent <br />B-2 General Business designation to the recently created Neighborhood Business District. He <br />noted that Lindy's has occupied its current place since 1961. <br /> <br />Mr. Lindimer stated the City's records show that the building was built in 1951. He added he <br />understands the building permit issued in 1951 was for a rebuild after a fire. He noted that the <br />site was owned and operated by another dining establislmlent, The Wagon Wheel, since 1930, <br /> <br />Mr. Lindimer addressed the purposcs of the Neighborhood Business District as outlincd in <br />Ordinance #315, He stated, with regard to-Item A, the business being located aUhe.edge of <br />
