An easement in a form acceptable to the City Attorney be provided for the existing lift station on the <br />property; <br />5. The applicant complies with any recommended changes provided by the City Engineer; <br />6. The applicant obtains all necessary pennits from the Rice Creek Water Shed District; <br />7, Compliance with the applicable provisions of the Zoning Ordinance <br />8. The applicant submits a landscape performance bond or other surety for 125% of the cost of materials and <br />installation valid one full year from the date of installation prior to the issuance of a building pennit <br />9. The applicant provides a sign easement for gateway signage near the intersection of County Road E2 and <br />Cleveland with an area, dimension, and at a location approved by City staff. <br />10. The City Engineer review and approve the design and access to Cleveland Avenue. <br />11. A lighting plan be submitted for staff review and approved by the Council. <br />12. The design and location for anyon-premise signage be approved by the City staff. <br />13. That after the end of the Bethel College supervised use of the development, any subsequent use be offered <br />only at a market rate. <br />14. A written PUD agreement acceptable to the City be submitted prior to approval ofthe Final Planned Unit <br />Development. <br /> <br />In response to the Plarming Commission's recommendation, the applicant has submitted updated <br />plans (including a lighting plan that is acceptable from a staff perspective). These plans are included <br />for your review. Subsequent to the public hearing, the City Administrator received a letter voicing _ <br />opposition to the proposed project. This is also attached for your reference. .. <br /> <br />The City Attorney has drafted a PUD Agreement addressing the issues identified in the Planning <br />Commission's approval. In addition, he also indicated that the property should be platted to be <br />consistent with our City Code. He also indicated that it is necessary for Council to authorize Beacon <br />Construction to submit its application for plat approval after the City approves the Final PUD. <br />Typically, plat approval is done concurrently with the PUD process. The above recommendation <br />requires that it be done prior the issuance of a certificate of occupancy. This is also a stipulation of <br />the Final PUD Permit and Development Agreement. Finally, after talking with the City Engineerm <br />they recommended that a Gateway sign be placed in County right of way as opposed to the property. <br /> <br />To summarize, aside from the recommendation by the Plarming Commission, it is necessary to do <br />the following to give final approval to the project: <br /> <br />I. Introduction and First Reading of Ordinance No. 332 an Ordinance amending Ordinance 291 <br />of the City of Arden Hills' Zoning Ordinance, Section 4 (A), relating to the rezoning of <br />property. <br />2. Authorize Staff to execute the PUD Permit and Development Agreement. <br />3. Authorize Beacon Construction to submit its application for plat approval after the City <br />approves the Final PUD. <br /> <br />10 <br /> <br />- <br />
