<br />. <br /> <br />e <br /> <br />e <br /> <br />ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 <br /> <br />11 <br /> <br />different types of housing units were included in the category of Dwelling in the Ordinance Land <br />Use Chart. <br /> <br />Ms. Chaput stated that Section 5 (H) 5b of the Ordinance pertaining to buffer yards requires 30 <br />feet in width adjacent to all residential uses, <br /> <br />Ms, Chaput stated the amendments were scheduled for review by the Council at their December <br />11 meeting, prior to a pending case in February 2001. She added the Commission could take <br />some time to review the issue, <br /> <br />Commissioner Baker stated the Council had indicated a priority in getting this resolved, adding <br />he would like to complete the NB District language amendments. <br /> <br />Commissioner Sand stated that multiple family uses should not be limited, and the regulations <br />should be as flexible as possible, Ms. Chaput stated that "outside the Neighborhood Business <br />District" should be added where the ordinance refers to adjacent residential uses, <br /> <br />Ms, Chaput stated she would review the amendments and insert additional language. She added <br />she would bring the issue to the next Planning Commission meeting, She noted she would <br />provide a definition for single family dwelling. <br /> <br />Commissioner Sand moved, seconded by Commissioner Baker, to table Planning Case #00-41, <br />Zoning Ordinance Amendment Section 5 (E), Land Use Chart and (H) #3, Special Requirements <br />for the Neighborhood Business District. The motion carried unanimously (5-0). <br /> <br />NEW BUSINESS <br /> <br />A. Appeal of Building Inspector's Decision to Deny Permit (Vaugban Tower) <br /> <br />Ms, Chaput explained that Dave Scherbel, City Building Official, denied a building permit <br />application for the construction of a new antenna tower at 1777 Gateway Boulevard. She added <br />the decision is being appealed by Mr. Vaughan, the property owner at 1777 Gateway Boulevard. <br />She noted that staff requests that the Commission review the information and make a <br />recommendation to deny or approve the appeal. <br /> <br />Chair Erickson asked whether there are any other buildings on the property besides the tower, the <br />height of which seems clear, Mr, Scherbel stated there is an equipment structure which is 20' x <br />20'. <br /> <br />Chair Erickson asked whether the current tower is operational. Mr. Scherbel confirmed this, <br />adding there are questions as to the safety of the tower. He added that the building permit <br />submitted for construction of a new tower could not be granted due to new zoning regulations, <br />He noted the permit could not be granted based on the City ordinance as it is currently written, <br /> <br />Mr. Scherbel stated that the existing tower can not be modified, and additional bracing will add <br />weight and surface area to the tower which would compound the problem. He added that the <br />owner is unwilling to reduce the height of the current tower because many of the tower's users <br />require a certain height for their transmissions, <br />
