<br />l- <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />CITY OF ARDEN HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />December 8, 2000 <br /> <br />TO: <br /> <br />Mayor and City Council <br /> <br />Jennifer Chaput, City Planner ~ <br /> <br />Case #00-37, Front Yard Setback Variance <br />Thomas Wbittles, 1867 Glen Paul Avenue <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Reouest <br />The applicant is requesting a front yard setback variance (35.5 feet proposed, when 40 feet is <br />required) for a kitchen addition at 1867 Glen Paul Avenue, zoned R-2 (Exhibit A), <br /> <br />Backl!:round <br />Mr. Whittles contacted the City for a building permit in August 2000, to discuss an addition to the <br />front of his home, At this time, it was identified that he required a front yard setback variance. The <br />City received his application on September 25, which was found incomplete because the request was <br />unclear and the applicant did not address the five hardship criteria, In response to my letter that his <br />application was incomplete, Mr. Whittles submitted a letter with his application request (Exhibit B), <br />At this time, the applicant was notified that the application was still incomplete since the hardship <br />criteria, as requested previously, was not addressed, Mr. Whittles submitted an additional letter <br />(Exhibit C), addressing the five hardship criteria, <br /> <br />Mr. Whittles came before the Planning Commission with Planning Case #98-19, variance for a side <br />yard setback for a detached garage (four feet where ten feet was required). The applicant informed <br />me that a survey was not required for this Planning Case and, upon further review, found that a <br />survey was not submitted, I discussed this issue with the Building Inspector who confirmed that he <br />did not have a survey for this property on file, However, the Building Inspector is convinced that Mr, <br />Whittles is aware of his property line locations so has not required a survey from him for work <br />completed in the, past. For your information, the Building Inspector has found that Mr. Whittles <br />installed the foundation for this project already, without a building permit. Plus, the foundation was <br />not installed to meet frost requirements and, if the variance is granted, will have to be re-done, <br /> <br />Currently, the central front portion ofMr, Whittles' home is situated 35,5 feet from the front yard <br />setback. It is currently non-conforming because it does not meet the front yard setback requirement. <br />The remainder of the home is 39,5 feet from the front yard setback. Mr. Whittles wishes to build an <br />addition onto his home from the 39.5 feet to be in line with the portion that is 35,5 feet from the <br />property line. The front yard setback for the B-2 zoning district is 40 feet. Therefore, he requires a <br />front yard setback variance, <br /> <br />Variance Findiul!:s <br />In order to grant a variance, a hardship must be identified, as defined by the City and State criteria. <br />The applicant has responded to the hardship criteria in a letter, as provided in Exhibit C.
