The applicant does not believe that they can <br />successfully market the site and meet this requirement. They would like to have the <br />opportunity to utilize this type of sign on an ongoing basis, The Sign Ordinance is <br />proposed to be revised in its entirety in the near future, This issue has been raised by <br />other property management companies within the City and it will be addressed in the <br />Ordinance revision. Staff suggests that no action be taken on this item until the Sign <br />Ordinance is revised or final PUD application is made, whichever comes first. <br /> <br />i) Lighting. The Zoning Ordinance requires that all sources of illumination be hooded, <br />concealed or controlled in a manner so as not to be visible from adjoining lots, streets or <br />highways or residential areas east and south of Round Lake. The Design Standards meet <br />these requirements, <br /> <br />j) Pedestrian Circulation. The City has identified a potential pedestrian trail along Round <br />Lake, connecting to this property and possibly across the railway bridge to New <br />Brighton, The parkland dedication required as part of the replatting the property for this <br />project is proposed to be partially utilized for pedestrian circulation, This will be a <br />requirement at the time of development ofthis property. <br /> <br />. <br /> <br />k) Drainage, Wetlauds and Flood Plain. The Engineer's comments state that the applicant <br />has met all of the requirements stated earlier in the Concept PUD, The applicant has <br />submitted a full EA W, with comments received by the Minnesota Department of Natural <br />Resources, Minnesota Pollution Control Agency and the Minnesota Historical Society, <br />This document includes a map of existing conditions, showing all significant natural <br />features, and grading, utility and erosion control plan. Development of the project will <br />require a limited amount of wetland encroachment, Proposed mitigation includes 2:1 <br />replacement of the impacted wetland with on-site ponding, A permit will be required <br />from Rice Creek Watershed District. <br /> <br />I) Shoreland Ordinance. The subject property is located in the Shoreland Management <br />area, per the Minnesota Department of Natural Resources (DNR), The City Code, in <br />Chapter 20.5-22, subpart 12 (a) defines a Shoreland as land located within 1,000 feet <br />from the ordinary high water mark of a lake, pond or flowage, The subject property is <br />within 1,000 feet of Round Lake, a DNR protected water. <br /> <br />The City Code, in Chapter 20.5-47 (a)#l permits the selective removal of natural <br />vegetation, provided that sufficient vegetative covers remains to screen cars, dwellings <br />and other structures when viewed from the water. Grading and excavation is allowed in a <br />shoreland area, as long as the following conditions are satisfied: <br /> <br />i) <br />ii) <br /> <br />The smallest amount of bare ground is exposed for as short a time as feasible; <br />Temporary ground cover, such as mulch, is used and permanent ground cover, <br />such as sod, is established; <br />Methods to prevent erosion and trap sediments are employed; and <br />Fill is stabilized to accepted engineering standards, approved by the City <br />Engineer. <br /> <br />. <br /> <br />iii) <br />iv) <br />
