<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />sixty days to April 5, 2001, The City may, with the petitioners' consent, extend the review <br />period beyond the April 5, 2001 date. <br /> <br />Recommendation <br />The Planning Commission recommended approval of this proposal, with conditions, as outlined <br />in the memorandum prepared for the February 26, 2001 City Council meeting, Since that time, <br />an issue affecting all applications has been identified and an alternative recommendation is being <br />proposed, <br /> <br />Staff recommends denial of Planning Case #00-45, for the following reasons: <br />1. The proposed minor subdivision of the property located at 1201 County Road E, creating two <br />parcels from one, leaves the Holiday Inn's remaining parcel with less than 25% landscape <br />area which is unable to meet the requirements of Section 5 (F) of the Zoning Ordinance; and <br />2, Since a minor subdivision of 1201 County Road E can not create a developable lot for a <br />proposed Walgreens, the remaining applications for: a variance from Section 6 (D) #1 (b), <br />proximity to drive-in businesses; a special Use Permit for a drive-in business in a B-2 <br />District; and site plan review, are not possible, All subsequent applications are denied based <br />on the fact that a minor subdivision of the property can not occur. <br /> <br />Notes <br />A majority vote from the City Council is required for action on the applications of this Plarullng <br />Case, If this application is denied, the application can not be resubmitted for a period of six (6) <br />months from the date of the denial. <br /> <br />Updates <br />The applicant is requesting that the City Council table the applications for the applicant to have a <br />chance to further review the issue currently raised on the Holiday Inn parcel. The applicant has <br />submitted a letter to the City Council to waive the sixty-day time limit (attached). <br /> <br />3 <br />
