<br />, <br /> <br />Zoning Review <br />Section 22-12, (e) of the City Code authorizes the division of platted lots according to certain <br />criteria, as outlined in previous staff memorandums. The minor subdivision proposes the division <br />of the Holiday Inn parcel (-8,2 acres) into two lots, creating a lot for Walgreens (-1.8 acres) and <br />leaving the remaining parcel for the Holiday Inn (6.4 acres), Both of the lots, as a result of the <br />minor subdivision, meet the dimensional and parking requirements ofthe Zoning Ordinance, as <br />presented in previous staff memorandums. <br /> <br />e <br /> <br />In Planning Case #71-37, the City Council approved a Special Use Permit to allow for the <br />construction of the Ramada Inn (Holiday Inn) as it stands today, It was approved for construction <br />to a height exceeding the 35' requirement of the Zoning Ordinance, Beyond this issue, it met all <br />other dimensional, landscape and parking requirements of the Ordinance, The required landscape <br />area was oddly placed at the eastern end of the site, meeting the 25% requirement of the area of <br />the site, <br /> <br />With the proposed split, the Holiday Inn loses all of the landscape area on the eastern end of the <br />site, leaving approximately 13% landscape area, However, the current Zoning Ordinance <br />continues to require 25% landscape area in the B-2 Zoning District. The Holiday Inn property did <br />not have previous City Council approval to have less than the required amount of landscape area. <br />To create a parcel that does not meet this requirement is creating a parcel that is nonconforming <br />by the Zoning Ordinance. <br /> <br />. <br /> <br />Options For Action <br />1. Recommend approval with conditions. Ifthe application is approved with conditions, a <br />landscape variance on the Holiday Inn parcel (-13% where 25% is required) would be <br />approved without an application from the property owner and without identifying a hardship, <br />2, Recommend denial with reasons for denial. The application for a minor subdivision can be <br />denied because one ofthe resulting lots is not able to meet the minimum landscape lot area <br />requirement of25%, creating a nonconforming lot. Denial of the minor subdivision, in turn, <br />denies all other applications since a parcel can not be created for the use, <br />3, The applicant could request an extension of time. The applicant may request to waive the <br />sixty day time limit, in writing, to the Council for additional time to address the landscaping <br />issue on the Holiday Inn parcel. <br />4. The applicant may choose to withdrawn the application. No action would be necessary, if <br />this is the case, <br /> <br />Deadline for Agencv Actions <br />The City of Arden Hills received a complete application for this request on December 6, 2000, <br />Pursuant to Minnesota State Statutes the City must act on this request by February 4,2001 (60 <br />days), unless the City provides the petitioner with written reasons for an additional60-day <br />review period, The applicant was notified, in writing, that the application would be extended . <br /> <br />2 <br />
